AN ACT TO PROHIBIT POLITICAL SUBDIVISIONS FROM ADOPTING OR ENFORCING AN ORDINANCE, RULE, RESOLUTION, REGULATION, CODE, ORDER, POLICY OR OTHER MEASURE THAT HAS THE PURPOSE OF BANNING, LIMITING, RESTRICTING, DISCRIMINATING AGAINST OR PROHIBITING A PERSON'S ABILITY TO USE THE SERVICE OF A NATURAL GAS OR ELECTRIC PUBLIC UTILITY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 77-3-99, Mississippi Code of 1972:
77-3-99. In accordance with the declaration of policy provided in Section 77-3-2(1), no political subdivision, as defined in Section 11-46-1, may adopt or enforce an ordinance, rule, resolution, regulation, code, order, policy or other measure, or an amendment of same, that has the purpose, intent or effect of directly or indirectly banning, limiting, restricting, discriminating against or prohibiting a person's ability to use the service of a natural gas or electric public utility, as defined in Section 77-3-3(d)(i) and (ii), based upon the type or source of energy to be delivered to the end-use customer. Nothing in this section limits or otherwise alters the authority of the Public Service Commission.
SECTION 2. This act shall take effect and be in force from and after its passage.
