AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF OXFORD, MISSISSIPPI, TO UTILIZE THE DUAL-PHASE DESIGN-BUILD METHOD OF CONSTRUCTION CONTRACTING FOR THE CONSTRUCTION OF PARKING FACILITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  As used in this act:

          (a)  "City" Means the City of Oxford, Mississippi.

          (b)  "Governing authorities" means the Mayor and Board of Aldermen of the City of Oxford, Mississippi.

          (c)  "Parking facility" means any property owned by the City of Oxford, Mississippi, and utilized as a public parking lot, garage or structure.

     SECTION 2.  The governing authorities are authorized and empowered, in their discretion, to design, establish, construct, acquire, maintain, improve, expand, enlarge and operate municipal parking facilities for motor vehicles belonging to members of the general public.

     SECTION 3.  In exercising the authority provided for in Section 1 of this act, the governing authorities are authorized and empowered, in their discretion, to use the dual-phase design-build method of construction contracting to design and construct the municipal parking facilities described in Section 1 of this act.

     SECTION 4.  The dual-phase design-build method of construction contracting shall be administered as provided for in Section 31-7-13.1 and may be authorized only when the governing authorities make a determination, entered on their minutes, with specific findings for the project demonstrating:

          (a)  How using the dual-phase design-build method of construction contracting for a parking facility provides a savings in time or cost over the traditional design-bid-build method of construction contracting; and

          (b)  How the size and type of the parking facility projects are suitable for dual-phase design-build method of construction contracting.

     SECTION 5.  The Legislature finds that, for the reasons stated in a resolution adopted by the governing authorities on February 15, 2015, entitled "A RESOLUTION AND ORDER REQUESTING INTRODUCTION AND PASSAGE OF STATE AND LOCAL AND PRIVATE LEGISLATION RELATED TO THE AUTHORITY OF THE CITY OF OXFORD TO CONSTRUCT MUNICIPAL PARKING FACILITIES," the dual-phase design-build method of construction contracting for parking facilities satisfies the public need better than the traditional design-bid-build method of construction contracting.

     SECTION 6.  This act shall take effect and be in force from and after its passage.
