STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fourteen
AN ACT establishing a commission to review the security of data collected by the state of New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Commission to Review the Security of Data Collected by the State of New Hampshire. Amend RSA 21-R by inserting after section 14 the following new subdivision:
Commission to Review the Security of Data Collected by the State of New Hampshire
21-R:15 Commission Established. There is established a commission to review the security of data collected by the state of New Hampshire.
I. The members of the commission shall be as follows:
(a) Two members of the house of representatives, appointed by the speaker of the house of representatives.
(b) Two members of the senate, appointed by the president of the senate.
(c) The commissioner of the department of information technology, or designee.
(d) Two data security specialists from the private sector, one of whom shall be appointed by the speaker of the house of representatives and one of whom shall be appointed by the senate president.
II. Members of the commission shall serve without compensation; except that legislative members shall receive mileage at the legislative rate when attending to the duties of the commission.
III. Members of the commission appointed under subparagraphs I(a)-(c) shall serve a term coterminous with their term in office. Members of the commission appointed under subparagraph I(d) shall serve a 2-year term.
IV. The commission shall meet at least once a year to assess the security of data shared with the federal government, to identify areas in which the state’s data security practices should be strengthened, and to suggest legislation, policies, and procedures to limit data sharing when the security of confidential data cannot be assured.
V. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Four members of the commission shall constitute a quorum.
VI. Beginning November 1, 2014, and each November 1 thereafter, the commission shall submit an annual report of its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library. A copy of the report shall also be posted on the general court website.
2 Effective Date. This act shall take effect upon its passage.
