STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Five
AN ACT relative to testimony of agency employees in general court hearings.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Standing Committees of the General Court; Agency Testimony. Amend RSA 17-D:3 to read as follows:
17-D:3 Investigations. Each permanent standing committee of the house and senate is authorized to invite public officials and employees and private individuals to appear before it for the purpose of submitting information to it. Each such committee shall be authorized to maintain a continuous review of the work of the state agencies concerned with its subject area and the performance of the functions of government within each such subject area, and for this purpose, to request reports, from time to time in such form as the committee shall designate, concerning the operation of any state agency and presenting any proposals or recommendations such agency may have with regard to existing laws or proposed legislation in its subject area. A state agency shall only provide information to the committee at the committee's request and shall not take a position in support of or in opposition to a matter before the committee.
2 State Employee Appearances Before the Legislature. Amend RSA 98-F:1 to read as follows:
98-F:1 State Employee Appearances Before the Legislature. State employees appearing in their official capacity before any legislative meeting or hearing for the purpose of [promoting or opposing, directly or indirectly,] providing information on any legislation pending or proposed before the general court shall wear their employee identification badges. In this section, "providing information" shall not include promoting or opposing, directly or indirectly, any legislation pending or proposed before the general court.
3 Effective Date. This act shall take effect 60 days after its passage.
