AN ACT relative to referral to the Sununu Youth Service Center of youths administered Narcan by a first responder for a heroin overdose.

This bill provides that a child administered Narcan by a first responder for a heroin overdose may be placed at the Sununu Youth Services Center pursuant to a voluntary services plan under RSA 169-D.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Seventeen
AN ACT relative to referral to the Sununu Youth Service Center of youths administered Narcan by a first responder for a heroin overdose.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Children in Need of Services; Placement at Sununu Youth Services Center. Amend RSA 169-D by inserting after section 5-c the following new section:
169-D:5-d Voluntary Service Plan; Placement at Sununu Youth Services Center. If a child 14 to 17 years old is administered Narcan by a law enforcement officer, firefighter, or other first responder for a heroin overdose, the officer shall file a petition under RSA 169-D:5, I and the child shall be referred for placement at the Sununu Youth Services Center. If the department of health and human services determines that placement at the center is appropriate for the education and treatment of the child, and the child's parent or guardian consents to the placement, the child may be placed at the Sununu Youth Services Center pursuant to a voluntary service plan, approved by the court, for a period of not more than 10 months or one school year. If the department determines that placement at the center is not appropriate, the department shall document the basis for its decision. The underlying petition shall be stayed pending the child's placement at the Sununu Youth Services Center and either dismissed or brought forward upon the child's discharge from the center.
2 Effective Date. This act shall take effect January 1, 2018.

METHODOLOGY:
This bill requires referral and assessment for placement at the Sununu Youth Services Center (SYSC) of youth administered Narcan for a heroin overdose. The Department of Health and Human Services is unable to determine the number of individuals who would be placed at the SYSC as a result of this bill, but notes that the per diem cost of placement is $420. Assuming that a youth were placed at the SYSC for the maximum ten months allowed by the bill, the cost per child would be approximately $128,000.
