An Act requiring posting of penalties for driving while intoxicated and supplementing Title 33 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. A person who holds a Class C license, except a plenary retail transit license or a club license, shall ensure that a warning notice prepared by the Division of Highway Traffic Safety in the Department of Law and Public Safety is posted prominently in any service area as well as on a wall, towel dispenser or other appropriate location in any public rest room for patrons on the licensed premises. The notice shall warn patrons of the penalties for driving while intoxicated. The notice shall also contain information regarding alternative forms of transportation, such as taxicab services, and advise patrons where the telephone numbers for such services can be obtained.
2. The Division of Highway Traffic Safety in the Department of Law and Public Safety shall prepare the notices required in section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill), in English and in Spanish, within two months after enactment of this act and shall distribute the notices to local boards of alcoholic beverage control for distribution to appropriate Class C licensees.
3. A person who fails to comply with the provisions of section 1 of P.L. , c. (C. ) (pending before the Legislature as this bill) shall be subject to a fine of $50.
4. The Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), shall adopt rules and regulations necessary to effectuate the provisions of this act.
5. This act shall take effect on the first day of the sixth month after enactment.
STATEMENT
This bill requires all Class C license holders, except for plenary retail transit license holders and club license holders, to prominently post notices in service areas and restrooms on their premises warning patrons of the penalties for driving while intoxicated. In addition, the bill requires the notices to contain information regarding alternative forms of transportation, such as taxicab services, and advise patrons where they can obtain the telephone numbers for such services.
Under the provisions of this bill, establishments that sell alcoholic beverages, including bars, restaurants, and liquor stores would be required to post the notices.
The Division of Highway Traffic Safety in the Department of Law and Public Safety would prepare the notices and distribute them to the local boards of alcoholic beverage control for distribution to the appropriate Class C licensees. The bill also provides for a penalty of $50 for a violation.
