An Act concerning bail and supplementing Title 2A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. In determining the appropriate amount and conditions of bail, the court shall, in addition to any other factors, consider whether a defendant is a member of a criminal street gang, as defined in section 1 of P.L.2007, c.341 (C.2C:33-29).
2. This act shall take effect immediately.
STATEMENT
This bill supplements Title 2A of the New Jersey Statutes to require the court, in addition to any other factors, to consider whether the defendant is a member of a criminal street gang in making a determination concerning the appropriate amount and conditions of bail.
