SYNOPSIS

     Concerns certain reductions of UI benefits due to receipt of SS payments.

An Act concerning social security and unemployment benefits and supplementing P.L.1980, c.13 (C.43:21-5a).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The amount of unemployment benefits payable to an individual for any week which begins in a period with respect to which the individual is receiving federal Social Security benefits shall be reduced, but not below zero, by an amount equal to 50 percent of the amount of the federal Social Security benefit payment which is reasonably attributable to that week; provided that the reduced weekly benefit rate shall be computed to the next lower multiple of $1.00 if not already a multiple thereof and that any reduction in the weekly benefit rate due to the individual's receipt of federal Social Security benefits shall reduce the maximum total benefits of the individual during the benefit year.

     Nothing in this section shall be construed so as to preclude an individual, who is otherwise eligible, from receiving any State or federal extension of unemployment compensation.

 

     2.    This act shall take effect on the 90th day after enactment.

 

 

STATEMENT

 

     This bill reduces the amount of unemployment insurance (UI) benefits payable to an individual for any week in which the individual is receiving federal social security (SS) payments. Under the bill, an individual's weekly UI benefit will be reduced, but not below zero, by an amount equal to 50 percent of the amount of the individual's SS payment reasonably attributable to that week. Also, any reduction of UI benefits made pursuant to the provisions of this bill will result in the reduction of the maximum total UI benefits available to the individual during the benefit year.
