SYNOPSIS

     Requires public and nonpublic high schools to have person trained in cardio-pulmonary resuscitation on site at all school athletic events and practices.

An Act concerning availability of persons trained in cardio-pulmonary resuscitation for school athletic events and supplementing Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Each school district in the State that operates a high school program in the district and each nonpublic high school shall ensure that a person with a current certification in cardio-pulmonary resuscitation is present on site at each athletic event in which the high school is the home team and at any team practice or intramural athletic event that occurs at the school.  The person present at the event or practice may be a designated employee of the school district or nonpublic high school, a licensed athletic trainer, or a State-certified emergency medical services provider or other first responder, as determined appropriate by the district or high school.

     b.    The school district and nonpublic high school shall arrange for training in cardio-pulmonary resuscitation of a sufficient number of designated employees to comply with the requirements of subsection a. of this section.

     c.     The training and certification in cardio-pulmonary resuscitation shall be provided through the American Red Cross, American Heart Association or other training program recognized by the Department of Health and Senior Services.

     d.    A school district or nonpublic high school and its employees shall be immune from civil liability in the provision of cardio-pulmonary resuscitation.

 

     2.    The State Board of Education, in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), shall adopt rules and regulations as may be necessary to implement the provisions of this act.

 

     3.    This act shall take effect immediately and shall first be applicable to the 2010-2011 school year.

 

 

STATEMENT

 

     The bill requires that each school district operating a high school program and each nonpublic high school ensure that an individual with a current certification in cardio-pulmonary resuscitation (CPR) is present at each athletic event at which the high school is the home team and at any team practices or intramural athletic events at the school.  The bill specifies that the designated individual may be a school employee, licensed athletic trainer, or State-certified emergency medical services provider, as determined by the school district.

     The school district and nonpublic high school shall arrange for training in CPR of a sufficient number of designated employees to comply with the requirements of this bill.  The training and certification in CPR must be provided through the American Red Cross, American Heart Association or other training program recognized by the Department of Health and Senior Services.  

     The bill provides immunity from civil liability to a school district or nonpublic high school and its employees in the provision of CPR.

     The bill takes effect immediately and will first be applicable to the 2010-2011 school year.
