SYNOPSIS

     Clarifies that the implementation of a municipal court security plan, shall be at the discretion of the municipal governing body.

An Act concerning the implementation of the municipal court security plan and supplementing Title 2B of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The implementation of a municipal court security plan, adopted by the local municipal court pursuant to a directive issued by the Administrative Office of the Courts, and prepared in consultation with the local law enforcement authority and municipal officials, shall, notwithstanding any other provision of law to the contrary, be at the discretion of the municipal governing body.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     The Supreme Court adopted a Statewide Municipal Court Security Policy ("the Policy) on July 6, 2006 which directed every New Jersey municipal court (1) to create a local municipal court security committee and (2) to develop a local municipal court security plan.  This policy was promulgated as Administrative Offices of the Courts Directive #15-06 ("Directive #15-06"), entitled "Statewide Municipal Court Security Policy," dated August 7, 2006.  The directive requires each municipal court to adopt a detailed Municipal Court Security Plan; the plan is to be submitted to the Assignment Judge of the vicinage for review.  The plan is required to address security measures which the directive enumerates.

     This bill clarifies that the implementation of a municipal court security plan, adopted by the local municipal court on the implementation of specific security measures shall be at the discretion of the municipal governing body.
