SYNOPSIS
Requires DHSS to provide written notice to certain federal, State and local elected officials upon the filing of application for certificate of need to close hospital.

An Act concerning closure of hospitals and supplementing Title 26 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. No later than the 30th day prior to the date of filing an application for a certificate of need pursuant to P.L.1971, c.136 (C.26:2H-1 et seq.) to close a general hospital, the general hospital shall provide written notice of its intent to file an application to the following elected officials in whose congressional or legislative district, or municipality, as applicable, the general hospital is located: federal officials elected from this State, State legislators, and the mayor.
b. When an application for a certificate of need to close a general hospital has been filed pursuant to P.L.1971, c.136 (C.26:2H-1 et seq.), the Commissioner of Health and Senior Services shall provide written notice of the application to the following elected officials in whose congressional or legislative district, or municipality, as applicable, the general hospital is located: federal officials elected from this State, State legislators, and the mayor.
c. The Department of Health and Senior Services shall not consider a general hospital's application for a certificate of need to close until the general hospital has provided the department with a copy of the notice of intent required under subsection a. of this section.
2. This act shall take effect immediately.
STATEMENT
The bill requires that a general hospital provide written notice of its intent to file a certificate of need to close pursuant to P.L.1971, c.136 (C.26:2H-1 et seq.), no later than the 30th day prior to filing its application with the Department of Health and Senior Services (DHSS), to the following elected officials in whose congressional or legislative district, or municipality, as applicable, the general hospital is located: federal officials elected from this State, State legislators, and the mayor.
Once the application has been filed, the bill requires that the Commissioner of Health and Senior Services provide written notice of the application to the above-mentioned elected officials.
Under the provisions of the bill, DHSS shall not consider a general hospital's application for a certificate of need to close until the general hospital has provided DHSS with a copy of the 30-day notice of intent sent to the above-mentioned elected officials.
