        AN ACT to amend the public service law, in relation to  requiring  tele-
          phone  corporations to waive the normal fees for caller identification
          service when providing the service to volunteer fire companies
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The public service law is amended by adding a new section
     2  103 to read as follows:
     3    § 103. Caller identification service fees. 1.  Telephone  corporations
     4  shall  waive  the  normal  fees  for  caller identification service when
     5  providing such service to volunteer fire companies.
     6    2. Definitions. As used in this section:
     7    (a) "Caller identification service" shall  refer  to  any  service  or
     8  device  designed  to  provide the user of the service or device with the
     9  telephone number of, or other information regarding the origination  of,
    10  a  call  made  using  a telecommunications service or VoIP service. Such
    11  term includes automatic number identification services.
    12    (b) "VoIP service" shall mean a service that provides real-time  voice
    13  communications  transmitted  through  end  user  equipment  using TCP/IP
    14  protocol, or a successor protocol, for a fee or without a  fee;  and  is
    15  offered  to  the  public,  or such classes of users as to be effectively
    16  available to the public (whether part of a bundle of services  or  sepa-
    17  rately);  and  has  the capability to originate traffic to, or terminate
    18  traffic from, the public switched telephone network.
    19    (c) "Volunteer fire companies" shall mean a duly  organized  volunteer
    20  fire  company  or volunteer fire department, approved by the authorities
    21  in control, of active volunteer firefighters of  such  fire  company  or
    22  department  and  whose  members  are  faithfully and actually performing
    23  service in the protection of life and property from fire or other  emer-

     1  gency,  accident  or  calamity  in connection with which the services of
     2  such fire company or fire department are required.
     3    §  2.  This  act shall take effect on the thirtieth day after it shall
     4  have become a law.
