       AN ACT to amend the executive law, in relation to the  establishment  of
         community justice councils
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The executive law is amended by adding  a new section 844-c
    2  to read as follows:
    3    S 844-C.  COMMUNITY JUSTICE COUNCILS. 1. A COMMUNITY  JUSTICE  COUNCIL
    4  SHALL  BE ESTABLISHED IN EACH COUNTY. SUCH COUNCILS SHALL PROVIDE PUBLIC
    5  SAFETY POLICY DIRECTION AND DEVELOP COMMUNITY JUSTICE PLANS.
    6    2. THE DIVISION SHALL REQUIRE, AS A CONDITION OF PAYMENT OF STATE  AID
    7  TO  A COUNTY OR MUNICIPAL PUBLIC SAFETY AGENCY, THAT A COMMUNITY JUSTICE
    8  PLAN BE SUBMITTED FOR THE COUNTY. THE COMMUNITY  JUSTICE  COUNCIL  SHALL
    9  SUBMIT THE PLAN REQUIRED BY THIS SUBDIVISION. THE COUNCIL SHALL SUBMIT A
   10  REVISED PLAN TO THE DIVISION EACH ODD-NUMBERED YEAR BY A DATE DESIGNATED
   11  BY  THE DIVISION. A PLAN MAY BE AMENDED AT ANY TIME WITH THE APPROVAL OF
   12  THE DIVISION. IN EVALUATING ANY APPLICATION OR PROPOSAL FOR  EXPENDITURE
   13  OF  STATE  FUNDS  IN  SUPPORT OF PUBLIC SAFETY ACTIVITY IN A COUNTY, THE
   14  DIVISION SHALL CONSIDER THE EXTENT TO WHICH  SUCH  PROPOSED  EXPENDITURE
   15  COMPLIES  WITH  OR  ADVANCES THE GOALS AND PRIORITIES ARTICULATED IN THE
   16  COUNTY'S COMMUNITY JUSTICE PLAN.
   17    3. A COMMUNITY JUSTICE PLAN REQUIRED UNDER THIS SECTION SHALL INCLUDE:
   18  (A) A STATEMENT OF PUBLIC SAFETY GOALS AND PRIORITIES; AND
   19    (B) A DESCRIPTION OF METHODS FOR MEASURING  THE  SUCCESS  OF  PROGRAMS
   20  FUNDED WITH STATE AID ADMINISTERED BY THE DIVISION.
   21    4.  A COMMUNITY JUSTICE COUNCIL SHALL CONSIST OF THE FOLLOWING PERSONS
   22  OR THEIR DESIGNEES:
   23    (A) THE DISTRICT ATTORNEY;
   24    (B) THE SHERIFF;

    1    (C) THE SENIOR COUNTY COURT JUDGE;
    2    (D)  A MUNICIPAL POLICE CHIEF CHOSEN BY THE POLICE CHIEFS OF THE MUNI-
    3  CIPALITIES OF THE COUNTY;
    4    (E) AN ELECTED MEMBER OF A LEGISLATIVE BODY OF A MUNICIPALITY  OF  THE
    5  COUNTY,  CHOSEN  BY THE MEMBERS OF THE LEGISLATIVE BODIES OF ALL MUNICI-
    6  PALITIES OF THE COUNTY;
    7    (F) NOT MORE THAN TWO STATE LEGISLATORS ELECTED FROM  THE  COUNTY  AND
    8  NOT  MORE THAN ONE STATE SENATOR CHOSEN BY THE STATE LEGISLATORS ELECTED
    9  FROM THE COUNTY; AND
   10    (G) AN ELECTED MEMBER OF THE  BOARD  OF  TRUSTEES  OF  AN  INDEPENDENT
   11  SCHOOL  DISTRICT  IN SUCH COUNTY, CHOSEN BY THE MEMBERS OF THE BOARDS OF
   12  TRUSTEES OF INDEPENDENT SCHOOL DISTRICTS LOCATED IN THE COUNTY.
   13    5. THE COMMUNITY JUSTICE COUNCIL SHALL  APPOINT  A  COMMUNITY  JUSTICE
   14  TASK  FORCE  TO PROVIDE SUPPORT STAFF FOR THE DEVELOPMENT OF A COMMUNITY
   15  JUSTICE PLAN. THE TASK FORCE MAY CONSIST OF ANY NUMBER OF  MEMBERS,  BUT
   16  SHOULD INCLUDE:
   17    (A) A CHIEF OF POLICE;
   18    (B) A PROBATION ADMINISTRATOR;
   19    (C) A SCHOOL SUPERINTENDENT;
   20    (D)  A  REPRESENTATIVE  OF  THE COMMANDER OF THE NEW YORK STATE POLICE
   21  TROOP SERVING THE COUNTY;
   22    (E) THE COUNTY COMMISSIONER OF MENTAL HEALTH;
   23    (F) A CHEMICAL DEPENDENCY TREATMENT PROFESSIONAL;
   24    (G) THE LOCAL OR REGIONAL REPRESENTATIVE OF THE DIVISION OF PAROLE;
   25    (H) A LICENSED ATTORNEY WHO PRACTICES IN THE COUNTY AND WHOSE PRACTICE
   26  CONSISTS PRIMARILY OF CRIMINAL LAW;
   27    (I) A COURT ADMINISTRATOR;
   28    (J) A REPRESENTATIVE OF A COMMUNITY SERVICE ORGANIZATION THAT PROVIDES
   29  ADULT TREATMENT, EDUCATIONAL OR VOCATIONAL SERVICES;
   30    (K) A REPRESENTATIVE OF A COMMUNITY SERVICE ORGANIZATION THAT PROVIDES
   31  TREATMENT, EDUCATIONAL OR VOCATIONAL SERVICES TO YOUTH;
   32    (L) A REPRESENTATIVE OF AN ORGANIZATION THAT IS ACTIVELY  INVOLVED  IN
   33  ISSUES RELATING TO DEFENDANTS' RIGHTS;
   34    (M) AN ADVOCATE FOR RIGHTS OF VICTIMS OF CRIME AND AWARENESS OF ISSUES
   35  AFFECTING VICTIMS;
   36    (N)  A  REPRESENTATIVE OF A NEIGHBORHOOD WATCH OR NEIGHBORHOOD ASSOCI-
   37  ATION; AND
   38    (O) A REPRESENTATIVE OF A COMMUNITY CRIME PREVENTION ORGANIZATION.
   39    S 2. This act shall take effect on the first of January next  succeed-
   40  ing the date on which it shall have become a law.
