        AN ACT to amend the education law, in relation to directing the board of
          trustees of the state university of New York and the board of trustees
          of the city university of New York to freeze tuition at  the  rate  of
          such  tuition  for  the  two  thousand twenty--two thousand twenty-one
          academic year

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subparagraph 4 of paragraph h of subdivision 2 of section
     2  355 of the education law, as amended by section 1 of part JJJ of chapter
     3  59 of the laws of 2017, is amended by adding a new subparagraph (vii) to
     4  read as follows:
     5    (vii) Commencing with the two thousand twenty-one--two thousand  twen-
     6  ty-two  academic year and thereafter, the board of trustees shall freeze
     7  the amount of tuition per credit hour per academic year at the  rate  of
     8  such  tuition  for  the  two  thousand  twenty--two  thousand twenty-one
     9  academic year. This freeze shall apply  to  tuition  for  full-time  and
    10  part-time  students  and to tuition for New York residents, out-of-state
    11  residents and on-line students.
    12    § 2. Subparagraph 4 of paragraph h of subdivision 2 of section 355  of
    13  the  education  law,  as  amended by chapter 437 of the laws of 2015, is
    14  amended to read as follows:
    15    (4) The trustees shall not impose a differential tuition charge  based
    16  upon  need  or income. All students enrolled in programs leading to like
    17  degrees at state-operated institutions of the state university shall  be
    18  charged  a uniform rate of tuition except for differential tuition rates
    19  based on state residency.  Provided,  however,  that  the  trustees  may
    20  authorize  the presidents of the colleges of technology and the colleges
    21  of agriculture and technology to set differing rates of tuition for each
    22  of the colleges for students enrolled in degree-granting programs  lead-

     1  ing  to  an associate degree and non-degree granting programs so long as
     2  such tuition rate does not exceed the tuition rate charged  to  students
     3  who  are enrolled in like degree programs or degree-granting undergradu-
     4  ate  programs  leading to a baccalaureate degree at other state-operated
     5  institutions of the state university of New York.   Notwithstanding  any
     6  other  provision  of  this  subparagraph, the trustees may authorize the
     7  setting of a separate category of tuition rate, that  shall  be  greater
     8  than  the  tuition  rate for resident students and less than the tuition
     9  rate for non-resident students, only for students enrolled  in  distance
    10  learning courses who are not residents of the state. [The trustees shall
    11  not  adopt  changes  affecting tuition charges prior to the enactment of
    12  the annual budget.] Commencing with  the  two  thousand  twenty-one--two
    13  thousand  twenty-two academic year and thereafter, the board of trustees
    14  shall freeze the amount of tuition per credit hour per academic year  at
    15  the rate of such tuition for the two thousand twenty--two thousand twen-
    16  ty-one  academic  year. This freeze shall apply to tuition for full-time
    17  and part-time students and to tuition for New  York  residents,  out-of-
    18  state residents and on-line students.
    19    §  3.  Paragraph (a) of subdivision 7 of section 6206 of the education
    20  law, as amended by section 2 of part JJJ of chapter 59 of  the  laws  of
    21  2017, is amended by adding a new subparagraph (vi) to read as follows:
    22    (vi)  Commencing  with the two thousand twenty-one--two thousand twen-
    23  ty-two academic year and thereafter, the board of trustees shall  freeze
    24  the  amount  of tuition per credit hour per academic year at the rate of
    25  such tuition  for  the  two  thousand  twenty--two  thousand  twenty-one
    26  academic  year.  This  freeze  shall  apply to tuition for full-time and
    27  part-time students and to tuition for New York  residents,  out-of-state
    28  residents and on-line students.
    29    §  4.  Paragraph (a) of subdivision 7 of section 6206 of the education
    30  law, as amended by chapter 327 of the laws of 2002,  the  opening  para-
    31  graph  as  amended  by  chapter  437  of the laws of 2015, is amended by
    32  adding a new subparagraph (iv) to read as follows:
    33    (iv) Commencing with the two thousand twenty-one--two  thousand  twen-
    34  ty-two  academic year and thereafter, the board of trustees shall freeze
    35  the amount of tuition per credit hour per academic year at the  rate  of
    36  such  tuition  for  the  two  thousand  twenty--two  thousand twenty-one
    37  academic year. This freeze shall apply  to  tuition  for  full-time  and
    38  part-time  students  and to tuition for New York residents, out-of-state
    39  residents and on-line students.
    40    § 5. This act shall take effect immediately and shall apply to academ-
    41  ic years commencing on and after July 1, 2021; provided, however, that:
    42    a. the amendments to subparagraph 4 of paragraph h of subdivision 2 of
    43  section 355 of the education law made by section one of this  act  shall
    44  be subject to the expiration and reversion of such subparagraph pursuant
    45  to  section 16 of chapter 260 of the laws of 2011, as amended, when upon
    46  such date the provisions of section two of this act shall  take  effect;
    47  and
    48    b. the amendments to paragraph (a) of subdivision 7 of section 6206 of
    49  the  education law made by section three of this act shall be subject to
    50  the expiration and reversion of such paragraph pursuant to section 16 of
    51  chapter 260 of the laws of 2011, as amended, when  upon  such  date  the
    52  provisions of section four of this act shall take effect.
