       AN ACT to amend the vehicle and traffic law,  in  relation  to  criminal
         liability  for  certain  motor  vehicle  owners'  failure  to maintain
         liability insurance
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  358 of the vehicle and traffic law is amended to
    2  read as follows:
    3    S 358. Otherwise violating THIS article. 1. Any  person  who  violates
    4  any  provision  of  this  article  for  which  another  penalty  is  not
    5  prescribed by law shall be punished by imprisonment for  not  more  than
    6  ninety  days  or  by a fine of not less than one hundred dollars or more
    7  than one thousand dollars or both.
    8    2. NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE  CONTRARY,
    9  ANY PERSON OR OWNER OF A MOTOR VEHICLE TRAILER, SEMI-TRAILER OR TRACTOR,
   10  OTHER  THAN  TRACTORS  USED  EXCLUSIVELY  FOR AGRICULTURAL PURPOSES, WHO
   11  KNOWINGLY FAILS TO MAINTAIN LIABILITY INSURANCE TO THE  EXTENT  REQUIRED
   12  BY LAW, SHALL BE GUILTY OF A CLASS E FELONY.
   13    S 2. This act shall take effect on the first of November next succeed-
   14  ing the date on which it shall have become a law.
