HYNDMAN -- read once and referred to the Commit- tee on Real Property Taxation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee AN ACT to amend the real property tax law, in relation to the impact of late filings on abatement benefits The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subparagraph (ii) of paragraph (a) of subdivision 5 of 2 section 489-cccccc of the real property tax law, as added by chapter 119 3 of the laws of 2008, is amended to read as follows: 4 (ii) Final application. Applicants shall file a final application for 5 benefits no later than one year from the date of issuance of the first 6 building permit for construction work, or, where construction work does 7 not require a building permit, no later than one year from the date of 8 commencement of construction. Abatement benefits shall not be granted 9 until the applicant files the final application. If the final applica- 10 tion is not filed within such one year period, abatement benefits shall 11 not be granted until such application is filed, and the department may 12 delay the granting of such benefits, at the department's discretion, to 13 investigate the reason for the late filing. 14 § 2. This act shall take effect immediately and shall apply to 15 projects that file preliminary applications on or after such date.
