AN ACT to amend the insurance law, in relation to insurance coverage of
in vitro fertilization and other fertility preservation treatments
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Item (iii) of subparagraph (C) of paragraph 6 of subsection
2 (k) of section 3221 of the insurance law, as amended by section 1 of
3 part L of chapter 57 of the laws of 2019, is amended to read as follows:
4 (iii) [Except as provided in items (vi) and (vii) of this subpara-
5 graph, coverage] Coverage shall not be required to include the diagnosis
6 and treatment of infertility in connection with: (I) [in vitro fertili-
7 zation, gamete intrafallopian tube transfers or zygote intrafallopian
8 tube transfers; (II)] the reversal of elective sterilizations; [(III)]
9 (II) sex change procedures; [(IV)] (III) cloning; or [(V)] (IV) medical
10 or surgical services or procedures that are deemed to be experimental in
11 accordance with clinical guidelines referenced in item (iv) of this
12 subparagraph.
13 § 2. Subparagraph (C) of paragraph 3 of subsection (s) of section 4303
14 of the insurance law, as amended by section 2 of part L of chapter 57 of
15 the laws of 2019, is amended to read as follows:
16 (C) [Except as provided in subparagraphs (F) and (G) of this para-
17 graph, coverage] Coverage shall not be required to include the diagnosis
18 and treatment of infertility in connection with: (i) [in vitro fertili-
19 zation, gamete intrafallopian tube transfers or zygote intrafallopian
20 tube transfers; (ii)] the reversal of elective sterilizations; [(iii)]
21 (ii) sex change procedures; [(iv)] (iii) cloning; or [(v)] (iv) medical
22 or surgical services or procedures that are deemed to be experimental in
23 accordance with clinical guidelines referenced in subparagraph (D) of
24 this paragraph.
25 § 3. This act shall take effect on the same date and in the same
26 manner as part L of chapter 57 of the laws of 2019, takes effect.
