        AN ACT to amend the executive law  and  the  general  business  law,  in
          relation  to requiring wireless communication method service providers
          disable services to stolen wireless communication methods

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Short title.  This act shall be known and may be cited as
     2  the "Detective Brian Simonsen's law".
     3    § 2. The executive law is amended by adding a  new  section  845-e  to
     4  read as follows:
     5    §  845-e. Notification of stolen wireless communication methods. When-
     6  ever any police officer designated  in  section  1.20  of  the  criminal
     7  procedure law or a peace officer designated in section 2.10 of such law,
     8  acting  pursuant  to his or her special duties, is made aware a wireless
     9  communication method has been stolen or is believed to have been stolen,
    10  such officer shall:
    11    1. where the wireless communication method is  a  wireless  telephone,
    12  notify  the  business  entity  which  was providing such stolen wireless
    13  telephone wireless telephone services and have such services  discontin-
    14  ued;
    15    2.  where the wireless communication method is an international mobile
    16  identification system, notify the business entity  which  was  providing
    17  such  international  mobile identification system and have such services
    18  discontinued;
    19    3. where the wireless communication method is an international  mobile
    20  equipment  identity number, notify the business entity which was provid-
    21  ing such international mobile equipment identity number  and  have  such
    22  services discontinued; and
    23    4.  where the wireless communication method is an international mobile
    24  subscriber identity number, notify the business entity which was provid-

     1  ing such international mobile subscriber identity number and  have  such
     2  services discontinued.
     3    §  3. The general business law is amended by adding a new section 399-
     4  eee to read as follows:
     5    § 399-eee. Disabling of  services  to  stolen  wireless  communication
     6  methods.  1.  Disabling  of  wireless telephone services.   Whenever any
     7  police officer designated in section 1.20 of the criminal procedure  law
     8  or a peace officer designated in section 2.10 of such law, acting pursu-
     9  ant  to  his  or her special duties, notifies any person, firm, partner-
    10  ship, association, limited  liability  company,  corporation,  or  other
    11  business  entity  providing wireless telephone services, as such term is
    12  defined in paragraph (b) of subdivision one of  section  twelve  hundred
    13  twenty-five-c  of  the  vehicle  and traffic law, that a telephone using
    14  such business entity's wireless telephone services has been stolen, such
    15  business entity shall cease wireless telephone services to  such  stolen
    16  telephone.
    17    2.  Disabling  of  stolen international mobile identification systems.
    18  Whenever any police officer designated in section 1.20 of  the  criminal
    19  procedure law or a peace officer designated in section 2.10 of such law,
    20  acting pursuant to his or her special duties, notifies any person, firm,
    21  partnership,  association,  limited  liability  company, corporation, or
    22  other business  entity  providing  international  mobile  identification
    23  systems that one of such business entity's systems has been stolen, such
    24  business entity shall cease services to such stolen system.
    25    3.  Disabling of stolen international mobile equipment identity number
    26  (IMEI). Whenever any police officer designated in section  1.20  of  the
    27  criminal  procedure law or a peace officer designated in section 2.10 of
    28  such law, acting pursuant to his or her  special  duties,  notifies  any
    29  person,  firm,  partnership,  association,  limited  liability  company,
    30  corporation, or other business  entity  providing  international  mobile
    31  equipment  identity  numbers  (IMEI)  that one of such business entity's
    32  numbers has been stolen, such business entity shall  cease  services  to
    33  such stolen number.
    34    4.  Disabling  of  stolen  international  mobile  subscriber  identity
    35  number.  Whenever any police officer designated in section 1.20  of  the
    36  criminal  procedure law or a peace officer designated in section 2.10 of
    37  such law, acting pursuant to his or her  special  duties,  notifies  any
    38  person,  firm,  partnership,  association,  limited  liability  company,
    39  corporation, or other business  entity  providing  international  mobile
    40  subscriber  identity  numbers that one of such business entity's numbers
    41  has been stolen, such business  entity  shall  cease  services  to  such
    42  stolen number.
    43    §  4.  This  act shall take effect on the ninetieth day after it shall
    44  have become a law.
