STATE OF NEW YORK ________________________________________________________________________ 8058 2023-2024 Regular Sessions IN ASSEMBLY September 27, 2023 ___________ Introduced by M. of A. K. BROWN -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to requiring cardiopulmo- nary resuscitation instruction as a part of the health education curriculum in all senior high schools The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 804-c of the education law, as added by chapter 269 2 of the laws of 1999, is amended to read as follows: 3 § 804-c. Cardiopulmonary resuscitation instruction. 1. Instructions 4 regarding cardiopulmonary resuscitation [may] shall be offered for 5 voluntary admission as a part of the health education curriculum in all 6 senior high schools. In addition to the requirement that all teachers of 7 health education shall be certified to teach health, persons instructing 8 pupils in cardiopulmonary resuscitation shall possess valid certif- 9 ication by an agency offering such certification in the performance of 10 cardiopulmonary resuscitation and in its instruction. 11 2. The commissioner may prescribe regulations governing such health 12 education courses which shall include instruction in cardiopulmonary 13 resuscitation. Such regulations shall in no event prescribe a course of 14 study in cardiopulmonary resuscitation which sets forth standards for 15 instruction of a lesser quality than the requirements of the programs 16 adopted by the American Heart Association or the American Red Cross. 17 3. School authorities [that choose to offer such course] shall provide 18 the needed facilities, time and place for the instruction set forth 19 herein and shall provide learning aids and curriculum resource materials 20 to support such course of study. 21 § 2. This act shall take effect on the first of July next succeeding 22 the date on which it shall have become a law. Effective immediately, the 23 addition, amendment and/or repeal of any rule or regulation necessary 24 for the implementation of this act on its effective date are authorized 25 to be made and completed on or before such effective date.
