AN ACT to amend the environmental conservation law, in relation to
allowing a municipality to offset costs for municipal recycling
projects by applying for additional funding without limiting the
availability of state funding
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Subdivision 1 of section 54-0701 of the environmental
2 conservation law, as amended by section 15 of part SS of chapter 59 of
3 the laws of 2009, is amended to read as follows:
4 1. "Cost" means the capital cost of a municipal recycling project
5 including engineering and architectural services, surveys, plans and
6 specifications; consultant and legal services; lands acquired pursuant
7 to the conditions set forth in section 54-0709 of this title, and other
8 direct capital expenses incident to such a project[, less any federal
9 assistance or other assistance received or to be received]. "Cost" shall
10 also include the capital, planning and promotional costs associated with
11 waste reduction projects, the costs related to household hazardous waste
12 collection and disposal programs, and the costs related to planning,
13 educational and promotional activities associated with a recyclables
14 recovery program. "Cost" shall also include beverage container assist-
15 ance program grants to municipalities and not-for-profit organizations
16 pursuant to section 27-1018 of this chapter. Provided, however, "cost"
17 shall exclude any cost incurred prior to April first, nineteen hundred
18 ninety-three, and shall further exclude costs related to planning,
19 educational and promotional activities associated with a recyclables
20 recovery program incurred prior to April first, two thousand.
21 § 2. This act shall take effect immediately.
