McENENY -- read once and referred to the Commit- tee on Tourism, Parks, Arts and Sports Development AN ACT authorizing the secretary of state to prepare recommendations for implementation of the management plan for the Mohawk Valley heritage corridor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any other provision of law, the secretary 2 of state (hereinafter referred to as the "secretary") is hereby author- 3 ized to prepare recommendations for the implementation of the county and 4 state approved management plan for the Mohawk Valley heritage corridor 5 area identified in paragraph (o) of subdivision 1 of section 35.03 of 6 the parks, recreation and historic preservation law. Such recommenda- 7 tions shall provide for continuing and advancing the management plan's 8 four goals of conservation, education, recreation and sustainable devel- 9 opment and participation of corridor municipalities, businesses, organ- 10 izations including, but not limited to, state and national heritage 11 areas located in whole or in part within the corridor and residents 12 following the scheduled repeal of article 37 of the parks, recreation 13 and historic preservation law, which created the Mohawk Valley heritage 14 corridor commission, on April 1, 2013. 15 S 2. In the process of preparation of recommendations the secretary 16 shall consult with the commissioner of the office of parks, recreation 17 and historic preservation, the commissioner of agriculture, the commis- 18 sioner of economic development, the commissioner of environmental 19 conservation, the chief executive officer of the Capital District 20 regional planning commission, the chairman of the New York state thruway 21 authority and canal corporation, the respective chairs of the Capital 22 region economic development council and the Mohawk Valley regional 23 economic development council and the chief executive officer of the 24 Oneida-Herkimer counties comprehensive planning program. In addition, 25 the chief elected official from each of the counties of Albany, Schenec- 26 tady, Montgomery, Schoharie, Herkimer, Fulton, Saratoga and Oneida shall 27 identify a representative from their respective county to advise the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14791-01-2 A. 9674 2 1 secretary on the interests and priorities of the counties with respect 2 to the management plan. The secretary shall also seek advice from each 3 city, town and village in such counties from representatives of a Native 4 American Indian nation with federal and/or state legal recognition who 5 resides in the Mohawk Valley and from state legislative and federal 6 congressional representatives whose districts are located in whole or in 7 part within the Mohawk Valley heritage corridor. 8 S 3. Within 3 months of the enactment of this act, the secretary shall 9 convene at least two public meetings in different portions of the Mohawk 10 Valley heritage corridor to evaluate the implementation of the corridor 11 management plan and seek recommendations for updating the management 12 plan and providing for a collaborative approach for its implementation. 13 Before February 1, 2013, the secretary shall make available draft recom- 14 mendations for implementation of the management plan and shall convene 15 at least two public meetings before March 1, 2013 to get comments on 16 such draft recommendations. On or before April 1, 2013, the secretary 17 shall submit recommendations for implementation including any comments 18 thereon received from the chief elected officials of each of the corri- 19 dor counties to such chief elected officials and to the Assembly and the 20 Senate of the state of New York. 21 S 4. This act shall take effect immediately.
