          Committee on Insurance

        AN ACT to amend the insurance law, in relation  to  prohibiting  medical
          malpractice insurance companies from taking any adverse action against
          a  reproductive  health  care provider who provides legal reproductive
          health care

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section  5504 of the insurance law is amended by adding a
     2  new subsection (g) to read as follows:
     3    (g) Policies issued by the association shall prohibit  an  insurer  of
     4  the  association  from  taking any adverse action against an abortion or
     5  reproductive health care provider who performs an abortion  or  provides
     6  reproductive health care that is legal in the state of New York on some-
     7  one  who  is  from  out  of the state. Such policy shall include medical
     8  professionals who prescribe abortion medication to out-of-state patients
     9  by means of telehealth.
    10    § 2. This act shall take effect immediately.
