        AN ACT to amend the social services law, in relation  to  providing  for
          flexibility in the funding of certain weatherization programs

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph a of subdivision 5 of section 97  of  the  social
     2  services  law, as amended by chapter 309 of the laws of 1996, is amended
     3  to read as follows:
     4    a. No less than ten percent of the funds available to New  York  state
     5  under  the  federal  low-income  home energy assistance program shall be
     6  allocated to the division of housing and community renewal, the  housing
     7  trust  fund  corporation, or the housing finance agency as designated by
     8  the division of housing and community renewal for [its] the  weatheriza-
     9  tion  assistance program and [shall be expended as] other low-cost resi-
    10  dential weatherization or other energy-related home repair  for  low-in-
    11  come  households.   All such programs and expenditures shall be provided
    12  in the annual New York state  weatherization  assistance  program  state
    13  plan or by agreement with the office of temporary and disability assist-
    14  ance.
    15    § 2. This act shall take effect immediately.
