        AN ACT to amend the penal law, in relation to establishing the crimes of
          travel to riot in the first degree and travel to riot  in  the  second
          degree

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1.  The penal law is amended by adding a new section 240.11 to
     2  read as follows:
     3  § 240.11 Travel to riot in the second degree.
     4    A person is guilty of travel to riot in the second degree when  he  or
     5  she:
     6    1.  (a)  commits  the crime of riot in the second degree as defined in
     7  section 240.05 of this article; or (b) commits the crime of inciting  to
     8  riot as defined in section 240.08 of this article; and
     9    2. does not reside in New York state.
    10    Travel  to riot in the second degree is a class E felony, and punisha-
    11  ble by a fine of up to one thousand dollars for a first offense, a  fine
    12  of  up  to three thousand dollars for a second offense, and a fine of up
    13  to five thousand dollars for a third offense and any subsequent offenses
    14  committed thereafter.
    15    § 2. The penal law is amended by adding a new section 240.12  to  read
    16  as follows:
    17  § 240.12 Travel to riot in the first degree.
    18    A  person  is  guilty of travel to riot in the first degree when he or
    19  she:
    20    1. commits the crime of riot in the first degree as defined in section
    21  240.06 of this article; and
    22    2. does not reside in New York state.
    23    Travel to riot in the first degree is a class D felony, and punishable
    24  by a fine of up to one thousand dollars for a first offense, a  fine  of
    25  up  to  three thousand dollars for a second offense, and a fine of up to
    26  five thousand dollars for a third offense and  any  subsequent  offenses
    27  committed thereafter.

     1    § 3. This act shall take effect immediately.
