D'Urso) -- read once and referred to the Committee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT authorizing the county of Nassau to alienate certain lands used as parklands to enable the Port Washington Water District to construct, maintain and operate a water treatment facility The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act, the county of Nassau 2 is hereby authorized, acting by and through its legislature, and upon 3 such terms and conditions as determined by such legislature, to discon- 4 tinue as parklands and convey the lands described in section three of 5 this act to the Port Washington Water District for the purpose of 6 constructing, maintaining and operating a water treatment facility and 7 appurtenances thereto. 8 § 2. The authorization in section one of this act shall be effective 9 only upon the condition that the county of Nassau dedicate an amount 10 equal to or greater than the fair market value of the parklands being 11 discontinued towards the acquisition of new parklands and/or capital 12 improvements to existing park and recreational facilities. 13 § 3. The parklands authorized by section one of this act to be discon- 14 tinued as parklands and alienated are described as follows: 15 All that certain plot, piece or parcel of land, situate, lying and 16 being at North Hills, Town of North Hempstead, County of Nassau and 17 State of New York, said parcel being more particularly bounded and 18 described as follows: 19 BEGINNING at a point on the easterly line of Searingtown Road, said 20 point being distant northerly the following three (3) courses as meas- 21 ured along said easterly line from its intersection with the old north- 22 erly line of the Westbound Service Road - Long Island Expressway; 23 1. North 11 degrees 02 minutes 30 seconds West, a distance of 246.30 24 feet to a point of curvature; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD16699-04-0A. 10652--A 2 1 2. Along the arc of a circular curve bearing to the right having a 2 radius of 1660.00 feet and a length of 365.54 feet to point of tangency; 3 3. North 01 degrees 34 minutes 30 seconds East, a distance of 310.00 4 feet; 5 RUNNING THENCE from said point of beginning the following six (6) 6 courses, the first course being along the easterly line of Searingtown 7 Road; 8 1. North 01 degrees 34 minutes 30 seconds East, a distance of 154.22 9 feet; 10 2. South 88 degrees 25 minutes 30 seconds East, a distance of 133.54 11 feet; 12 3. South 01 degrees 34 minutes 30 seconds West, a distance of 158.55 13 feet; 14 4. South 33 degrees 01 minute 56 seconds West, a distance of 102.59 15 feet; 16 5. North 01 degrees 34 minutes 30 seconds East, a distance of 91.84 17 feet; 18 6. North 88 degrees 25 minutes 30 seconds West, a distance of 80.00 19 feet to the easterly line of Searingtown Road and the point or place of 20 BEGINNING. 21 Containing within said bounds 23,169 Sq. Ft. or 0.532 Acres, more or 22 less. 23 § 4. Should the lands described in section three of this act cease to 24 be used for the purposes described in section one of this act, those 25 lands shall be restored for public park and recreational purposes with 26 the cost of restoration being borne by the Port Washington Water 27 District. 28 § 5. In the event that the county of Nassau received any funding 29 support or assistance from the federal government for the purchase, 30 maintenance, or improvement of the parklands set forth in section three 31 of this act, the discontinuance and alienation of such parklands author- 32 ized by the provisions of this act shall not occur until the county of 33 Nassau has complied with any federal requirements pertaining to the 34 alienation or conversion of parklands, including satisfying the secre- 35 tary of the interior that the alienation or conversion complies with all 36 conditions which the secretary of the interior deems necessary to assure 37 the substitution of other lands shall be equivalent in fair market value 38 and usefulness to the lands being alienated or converted. 39 § 6. This act shall take effect immediately.
