STATE OF NEW YORK ________________________________________________________________________ 1425 2023-2024 Regular Sessions IN SENATE January 11, 2023 ___________ Introduced by Sen. BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Cities 1 AN ACT to require that the siting, construction and establishment of supportive housing facilities in cities having a population of one million or more be disbursed in the boroughs of such cities in propor- tion to the population of each such borough The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any provision of law to the contrary, with- 2 in cities having a population of one million or more, supportive housing 3 facilities within each such city shall be sited, constructed and/or 4 established throughout the boroughs of the city in proportion to each 5 borough's population to the city's total population. Provided, however, 6 that the provisions of this section shall not apply to the siting, 7 construction or establishment of any supportive housing facility for 8 which the appropriate community board or, if there be no community 9 board, the appropriate neighborhood board shall have granted an 10 exemption from such provisions. 11 § 2. Supportive housing facilities sited, constructed and/or estab- 12 lished in cities having a population of one million or more after the 13 effective date of this act shall be located in those boroughs of the 14 city which have the lowest concentration of such facilities in propor- 15 tion to the borough population to the city's population. 16 § 3. Notwithstanding any other provision of law to the contrary, no 17 supportive housing facility shall be sited, constructed or established 18 within a city of one million or more unless the appropriate community 19 board, or, if there be no community board, the appropriate neighborhood 20 board shall have approved the siting, construction or establishment of 21 such facility. 22 § 4. For the purposes of this act, "supportive housing facility" means 23 multiple residences operated by not-for-profit organizations and funded EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04476-01-3S. 1425 2 1 by federal, state and municipal governments, which provide housing 2 accommodations and support services to tenants having mental illness, 3 trauma, abuse, chemical dependency and/or chronic illness; and shelters 4 for the homeless, abused women and children, and veterans. 5 § 5. This act shall take effect immediately.
