       AN  ACT to amend chapter 422 of the laws of 2008, relating to creating a
         public library district in the city of Troy, in the county of  Rensse-
         laer, in relation to the public library's finances
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 1 of section 4 of chapter 422 of  the  laws  of
    2  2008,  relating  to  creating  a  public library district in the city of
    3  Troy, in the county of Rensselaer, as amended by chapter 321 of the laws
    4  of 2009, is amended to read as follows:
    5    1. The initial budget for the public library district shall be  deter-
    6  mined by a vote of the voters of the district in the initial election as
    7  hereinafter  provided  for. All future budgets that increase or decrease
    8  THE DISTRICT'S PROPOSED TAX LEVY AS COMPARED TO  THE  TAX  LEVY  IN  THE
    9  PRECEDING  FISCAL  YEAR'S  BUDGET  AND the public library proposed total
   10  operating expenditures over the total operating expenditures in the last
   11  preceding fiscal year's budget  shall  be  submitted  to  the  residents
   12  voting  at  the  annual  election of trustees pursuant to section two of
   13  this act. Funds voted for library purposes at the initial  election  and
   14  at  all  future budget elections shall be considered an annual appropri-
   15  ation therefor and shall be levied and  collected  yearly  in  the  same
   16  manner  and  at  the  same  time as other taxes in the city of Troy, AND
   17  SHALL BE PAID OVER IN FULL TO THE PUBLIC LIBRARY DISTRICT, WITH NO  LESS
   18  THAN  HALF OF THE AMOUNT OF THE TAX LEVY TO BE PAID BEFORE THE FIRST DAY
   19  OF MARCH AND THE FULL BALANCE OF THE AMOUNT OF THE TAX LEVY PAID  BEFORE
   20  THE  FIRST  DAY  OF  SEPTEMBER.   The initial fiscal year of the library

    1  district shall be January 1 of the year immediately succeeding the  year
    2  in  which  the  library  district  shall come into existence through and
    3  including December 31 of that year. Taxes voted on and approved for  the
    4  support  of  the  library  district for the initial fiscal year shall be
    5  assessed and levied by  December  of  the  year  in  which  the  library
    6  district shall come into existence and shall be included in the tax bill
    7  for  which  payment  is due in the following January. Taxes voted on and
    8  approved for the support of the library district for  subsequent  fiscal
    9  years  shall  be  levied  in  the  calendar  year directly preceding the
   10  library district's fiscal year and shall be included in  the  tax  bills
   11  issued during December of the calendar year preceding the fiscal year.
