       AN ACT to amend the vehicle and traffic law, in  relation  to  providing
         for identification cards for individuals with autism spectrum disorder
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
    2  article 17-D to read as follows:
    3                                ARTICLE 17-D
    4                        AUTISM SPECTRUM DISORDER CARD
    5  SECTION 499-H. AUTISM SPECTRUM DISORDER CARD.
    6    S  499-H.  AUTISM SPECTRUM DISORDER CARD. UPON THE REQUEST OF A PERSON
    7  WITH AN AUTISM SPECTRUM DISORDER, OR THE GUARDIAN OR CAREGIVER  OF  SUCH
    8  PERSON,  THE  DEPARTMENT SHALL ISSUE, IN ACCORDANCE WITH ELIGIBILITY AND
    9  DOCUMENTATION CRITERIA ESTABLISHED FOR SUCH PURPOSE AND FOR A FEE NOT TO
   10  EXCEED FIVE DOLLARS, AN IDENTIFICATION CARD DENOTING  THAT  SUCH  PERSON
   11  HAS BEEN MEDICALLY DIAGNOSED WITH AN AUTISM SPECTRUM DISORDER. SUCH CARD
   12  SHALL  INDICATE  THE  NAME, ADDRESS AND DATE OF BIRTH OF THE CARD BEARER
   13  AND, AT THE CARD BEARER'S DISCRETION, THE NAME AND PHONE  NUMBER  OF  AN
   14  INDIVIDUAL  DESIGNATED  BY  THE  CARD  BEARER TO BE CONTACTED IN CASE OF
   15  EMERGENCY. THE CARD SHALL CONTAIN A STATEMENT EXPLAINING AUTISM SPECTRUM
   16  DISORDERS, AND HOW THEY MAY GIVE RISE TO PHYSICAL AGITATION  AND  IMPAIR
   17  AN  INDIVIDUAL'S  ABILITY TO COMMUNICATE OR RESPOND TO DIRECTIONS.  SUCH
   18  CARD SHALL FURTHER INDICATE THAT IT HAS BEEN ISSUED  BY  THE  DEPARTMENT
   19  PURSUANT  TO  THIS  ARTICLE. THE IDENTIFICATION CARD MAY BE PRESENTED TO
   20  LAW ENFORCEMENT AS NECESSARY.
   21    S 2. This act shall take effect immediately.
