STATE OF NEW YORK ________________________________________________________________________ 6398 2017-2018 Regular Sessions IN SENATE May 16, 2017 ___________ Introduced by Sen. GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to granting sick leave for officers and employees with a qualifying World Trade Center condition The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The general municipal law is amended by adding a new 2 section 92-d to read as follows: 3 § 92-d. Sick leave for officers and employees with a qualifying World 4 Trade Center condition. Notwithstanding any other law, rule or regu- 5 lation to the contrary, officers and employees of any municipal corpo- 6 ration or public authority outside of a city with a population of one 7 million or more who previously filed a notice of participation in World 8 Trade Center rescue, recovery or cleanup operations and subsequently 9 develop a qualifying World Trade Center condition, as defined in section 10 two of the retirement and social security law, while employed with such 11 municipal corporation or public authority shall be granted line of duty 12 sick leave. The officer or employee shall be compensated at his or her 13 regular rate of pay for those regular work hours during which the offi- 14 cer or employee is absent from work. Such leave shall be provided with- 15 out loss of an officer or employee's accrued sick leave. 16 § 2. This act shall take effect on the ninetieth day after it shall 17 have become a law; provided, however, that effective immediately, the 18 addition, amendment and/or repeal of any rule or regulation necessary 19 for the implementation of this act on its effective date is authorized 20 and directed to be made and completed on or before such effective date.
