        AN ACT to amend the vehicle and traffic law, in relation to establishing
          a residential parking system in the city of Rochester
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 1640-p to read as follows:
     3    § 1640-p. Residential parking permit system in the city of  Rochester.
     4  1.  Notwithstanding  the provisions of any law to the contrary, the city
     5  council of the city of Rochester may, by adoption  of  a  local  law  or
     6  ordinance,  provide  for a residential parking permit system and fix and
     7  require the payment of fees applicable to parking  within  the  area  in
     8  which such parking system is in effect in accordance with the provisions
     9  of this section.
    10    2.  Such  residential  parking  permit  system may only be established
    11  within the area of the city of Rochester  consisting  of  the  following
    12  streets:
    13    East Main Street: From Prince Street to Alexander Street.
    14    Birch Crescent: From East Main Street to North Goodman Street.
    15    Alexander Street: From East Main Street to Champeney Terrace.
    16    Champeney Terrace: From Union Street to Prince Street.
    17    Prince Street: From Champeney Terrace to East Main Street.
    18    Kenilworth Terrace: From North Union Street to Prince Street.
    19    3. Notwithstanding the foregoing, no permit shall be required on those
    20  portions  of  such  streets  where the adjacent properties are zoned for
    21  commercial/retail use.
    22    4. The local law or ordinance providing for such  residential  parking
    23  permit system shall:
    24    (a)  set  forth  factors  necessitating  the enactment of such parking
    25  permit system;

     1    (b) provide that motor vehicles registered pursuant  to  section  four
     2  hundred  four-a of this chapter shall be exempt from any permit require-
     3  ment;
     4    (c)  provide the times of day and days of the week during which permit
     5  requirements shall be in effect;
     6    (d) make not less than twenty percent of the spaces within the  permit
     7  area  available to nonresidents, and shall provide short term parking of
     8  not less than ninety minutes in duration in the permit area;
     9    (e) provide the schedule of fees to be paid for such permits; and
    10    (f) provide that such fees shall be credited to the  general  fund  of
    11  the city of Rochester.
    12    5.  No  ordinance  shall  be  adopted pursuant to this section until a
    13  public hearing thereon has been had in the same manner as  required  for
    14  public hearings on a local law pursuant to the municipal home rule law.
    15    §  2.  This  act  shall take effect on the sixtieth day after it shall
    16  have become a law.
