AN ACT to amend the elder law and the economic development law, in
relation to encore entrepreneurship
The People of the State of New York, represented in Senate and Assem-
bly, do enact as follows:
1 Section 1. Subdivisions 15 and 16 of section 202 of the elder law,
2 subdivision 15 as amended by section 31-b of part AA of chapter 56 of
3 the laws of 2019 and subdivision 16 as added by chapter 455 of the laws
4 of 2016, are amended and a new subdivision 17 is added to read as
5 follows:
6 15. to periodically, in consultation with the state director of veter-
7 ans' services, review the programs operated by the office to ensure that
8 the needs of the state's aging veteran population are being met and to
9 develop improvements to programs to meet such needs; [and]
10 16. to the extent appropriations are available, and in consultation
11 with the office of children and family services, conduct a public educa-
12 tion campaign that emphasizes zero-tolerance for elder abuse. Such
13 campaign shall include information about the signs and symptoms of elder
14 abuse, identification of potential causes of elder abuse, resources
15 available to assist in the prevention of elder abuse, where suspected
16 elder abuse can be reported, contact information for programs offering
17 services to victims of elder abuse such as counseling, and assistance
18 with arranging personal care and shelter. Such campaign may include, but
19 not be limited to: printed educational and informational materials;
20 audio, video, electronic, other media; and public service announcements
21 or advertisements[.]; and
22 17. to, in cooperation with the department of economic development,
23 make recommendations to the governor and legislature on expanding encore
24 entrepreneurship in the state, to empower individuals fifty years of age
25 or older to establish small businesses. The director and the president
26 of empire state development shall establish an advisory committee to
27 carry out the provisions of this subdivision. Such committee shall
28 include, but not be limited to, economic development professionals,

1 small business support specialists, senior citizens organizations, and
2 successful encore entrepreneurs. For purposes of this subdivision the
3 term "encore entrepreneur" shall mean a person fifty years of age or
4 older who is starting a small business for the first time, and the term
5 "small business" shall mean a business that is located within the state,
6 independently owned and operated and employs not more than fifty
7 persons.
8 § 2. Section 134 of the economic development law is amended by adding
9 a new subdivision 13 to read as follows:
10 13. initiate and implement a program to provide education and training
11 specific to the needs of individuals fifty years of age or older regard-
12 ing the transition from a current job, retirement or other life status
13 to an encore entrepreneur and small business developer. Such program
14 shall address the unique issues faced by such entrepreneurs and identify
15 and disseminate helpful and relevant information and resources to assist
16 such individuals with such transition. For purposes of this subdivision
17 the term "encore entrepreneur" shall mean a person fifty years of age or
18 older who is starting a small business for the first time, and the term
19 "small business" shall mean a business that is located within the state,
20 independently owned and operated and employs not more than fifty
21 persons.
22 § 3. This act shall take effect on the ninetieth day after it shall
23 have become a law. Effective immediately, the addition, amendment and/or
24 repeal of any rule or regulation necessary for the implementation of
25 this act on its effective date are authorized to be made and completed
26 on or before such date.
