STATE OF NEW YORK ________________________________________________________________________ 8535 IN SENATE June 8, 2020 ___________ Introduced by Sen. THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT authorizing the town of Hempstead to transfer and convey certain state land to Levittown school district The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act, the town of Hemp- 2 stead, county of Nassau, acting by and through its governing body and 3 upon such terms and conditions as determined by such body, is hereby 4 authorized to discontinue as parklands and to alienate the lands 5 described in section three of this act to the Levittown School District 6 for the purpose of expanding parking and accesses facilities for Jonas 7 E. Salk Middle School. 8 § 2. The authorization provided in section one of this act shall be 9 effective only upon the condition that the Levittown School District 10 convey to the town of Hempstead, and that the town of Hempstead acquire 11 and dedicate the lands described in section four of this act as park- 12 lands, provided that the town of Hempstead has never used such lands for 13 public open space or park purposes. 14 § 3. The parklands authorized by section one of this act to be alien- 15 ated are described as follows: ALL that certain plot, piece or parcel 16 of land, situate, lying and being at Levittown, Town of Hempstead, Coun- 17 ty of Nassau and State of New York, known and designated as and by Lot 18 Number 18 in Block 192 on a certain map entitled "Subdivision Map Levit- 19 town Section 30" and filed in the Office of the Clerk of the County of 20 Nassau on April 6, 1951 as Case Number 5197, said parcel being more 21 particularly bounded and described as follows: 22 BEGINNING at the corner formed by the intersection of the widened 23 northerly side of North Jerusalem Road with the easterly side of Water 24 Lane South: 25 RUNNING THENCE from said point of beginning the following nine (9) 26 courses, the first course being along said easterly side of Water Lane 27 South; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD16254-10-0S. 8535 2 1 1. North 24 degrees 57 minutes 45 seconds East, a distance of 41.79 2 feet to the southerly side of Serpentine Lane and the beginning of a 3 non-tangent curve; 4 2. Easterly along said Serpentine Lane, along the arc of a circular 5 curve bearing to the left having a radius of 550.32 feet and a length of 6 174.51 feet to a point of tangency; 7 3. South 83 degrees 12 minutes 24 seconds East still along said south- 8 erly side of Serpentine Lane, a distance of 126.43 feet; 9 4. South 06 degrees 47 minutes 36 seconds West, a distance of 100.00 10 feet; 11 5. South 84 degrees 50 minutes 49 seconds East, a distance of 113.91 12 feet; 13 6. North 74 degrees 20 minutes 04 seconds East, a distance of 89.94 14 feet; 15 7. North 38 degrees 13 minutes 38 seconds East, a distance of 179.41 16 feet; 17 8. South 00 degrees 06 minutes 37 seconds West, a distance of 314.56 18 feet to the widened northerly side of North Jerusalem Road; and 19 9. North 65 degrees 02 minutes 15 seconds West along said northerly 20 side of North Jerusalem Road, a distance of 671.71 feet to the easterly 21 side of Water Lane South and the point or place of BEGINNING. 22 Containing within said bounds 57,434 Sq. Ft. or 1.318 Acres, more or 23 less. 24 § 4. Prior to the discontinuance and alienation of the parklands 25 described in section three of this act, the Levittown school district 26 shall convey to the town of Hempstead and the town of Hempstead shall 27 acquire and dedicate as parklands such land described as follows: 28 Nassau County Tax Map Section 51 Block 492 part of Lot 28 29 All that certain plot, piece or parcel of land, situate, lying and 30 being in Levittown, Town of Hempstead, County of Nassau and State of New 31 York, being more particularly and described as follows: 32 Beginning at a point on the westerly side of Seamans Neck Road, 33 distant 610.76 feet southerly from the corner formed by the intersection 34 of the southerly side of Hunt Road with the westerly side of Seamans 35 Neck Road; 36 Running Thence South 01 degrees 28 minutes 55 seconds West, 81.39 feet 37 along the westerly side of Seamans Neck Road; 38 Thence South 89 degrees 37 minutes 47 Seconds West, 387.55 feet; 39 Thence North 00 degrees 22 minutes 13 seconds West, 104.34 feet; 40 Thence South 86 degrees 59 minutes 42 seconds East, 390.86 feet to the 41 westerly side of Seamans Neck Road and the POINT OR PLACE OF BEGINNING. 42 Containing 36,118 square feet or 0.829 acres, more or less. 43 § 5. In the event that the fair market value of the lands described in 44 section four of this act to be dedicated by the town of Hempstead pursu- 45 ant to this act are not equal to or greater than the fair market value 46 of the parklands to be alienated as described in section three of this 47 act, the town of Hempstead, shall dedicate the difference of fair market 48 value of the lands to be alienated and the lands to be dedicated for the 49 acquisition of additional parklands and/or capital improvements to 50 existing park and recreational facilities. 51 § 6. In the event that the town of Hempstead received any funding 52 support or assistance from the federal government for the purchase, 53 maintenance or improvement of the parklands set forth in section three 54 of this act, the discontinuance and alienation of such parkland author- 55 ized by the provisions of this act shall not occur until the town of 56 Hempstead has complied with any federal requirements pertaining to theS. 8535 3 1 alienation or conversion of such parklands, including satisfying the 2 secretary of the interior that the alienation or conversion complies 3 with all conditions which the secretary of the interior deems necessary 4 to assure the substitution of other lands shall be equivalent in fair 5 market value and usefulness to the lands being alienated or converted. 6 § 7. This act shall take effect immediately.
