A BILL

To enact section 3718.026 of the Revised Code to

authorize a board of county commissioners or

2

municipal legislative authority to reject the

3

application of any rule adopted after January 1,

4

2014, by the Department of Health governing the

5

design of household sewage treatment systems.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1.  That section 3718.026 of the Revised Code be	7
enacted to read as follows:	8

Sec. 3718.026.  (A) A board of county commissioners or the	9
legislative authority of a municipal corporation, by a majority	10
vote of the full membership of the board or legislative authority,	11
may reject the application within the county or municipal	12
corporation, as applicable, of any rule governing the design of a	13
household sewage treatment system adopted by the department of	14
health after January 1, 2014.	15

(B) If the board of county commissioners or the legislative	16
authority of a municipal corporation votes to reject the	17
application of a rule under division (A) of this section, the	18
board of health of the applicable health district shall administer	19
within the county or municipal corporation, as applicable, the	20
rules adopted by the department governing the design of a	21
household sewage treatment system that existed on January 1, 2014.	22
