BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That sections 3742.55 and 3742.56 of the Revised | 5 |
Code be enacted to read as follows: | 6 |
Sec. 3742.55. As used in this section and section 3742.56 of | 7 |
the Revised Code: | 8 |
(A) "Costs of lead hazard removal" means all costs associated | 9 |
with the removal of lead hazards from a qualified homeowner's | 10 |
primary residence, including hiring and paying contractors and | 11 |
storing household furnishings and other belongings taken from the | 12 |
residence. | 13 |
(B) "Federal poverty guideline" means the official poverty | 14 |
line as revised annually in accordance with section 673(2) of the | 15 |
"Omnibus Budget Reconciliation Act of 1981," 95 Stat. 511, 42 | 16 |
U.S.C. 9902, as amended. | 17 |
(C) "Qualified homeowner" means a person who owns and resides | 18 |
in a single-family home as a primary residence and to whom all of | 19 |
the following apply: | 20 |
(1) The income of the household of which the person is a | 21 |
member is less than or equal to two hundred per cent of the | 22 |
federal poverty guideline. | 23 |
(2) The person resides with a minor. | 24 |
(3) The home is subject to a lead hazard control order issued | 25 |
under section 3742.37 of the Revised Code. | 26 |
(4) The person meets all other qualifications required under | 27 |
federal law. | 28 |
Sec. 3742.56. The director of development shall establish, | 29 |
maintain, and administer a program to provide grants of amounts up | 30 |
to twenty thousand dollars to qualified homeowners to pay the cost | 31 |
of lead hazard removal. The director of development, in | 32 |
consultation with the director of job and family services, shall | 33 |
adopt rules in accordance with Chapter 119. of the Revised Code | 34 |
necessary to establish, maintain, and administer the program. | 35 |
Section 2. Up to $25,000,000 in fiscal years 2010 and 2011 | 36 |
from appropriation items 600410, TANF State, or 600689, TANF | 37 |
Block Grant, whichever the Department of Job and Family Services | 38 |
determines is most appropriate, shall be used to provide grants to | 39 |
cover the costs of lead hazard removal pursuant to sections | 40 |
3742.55 and 3742.56 of the Revised Code. If necessary, the | 41 |
Director of Budget and Management shall create appropriation items | 42 |
in the budget of the Department of Development, and adjust | 43 |
appropriations in the budgets of the Department of Development and | 44 |
the Department of Job and Family Services as needed to implement | 45 |
this program. The funds are hereby appropriated. | 46 |
Section 3. The codified and uncodified sections of law | 47 |
contained in this act are not subject to the referendum. | 48 |
Therefore, under Ohio Constitution, Article II, Section 1d and | 49 |
section 1.471 of the Revised Code, the codified and uncodified | 50 |
sections of law contained in this act go into immediate effect | 51 |
when this act becomes law. | 52 |
