| AN ACT |
| |
1 | Amending Title 4 (Amusements) of the Pennsylvania Consolidated |
2 | Statutes, further providing for general and specific powers; |
3 | and providing for child endangerment protection. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1202(b) of Title 4 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a paragraph to read: |
8 | § 1202. General and specific powers. |

10 | (b) Specific powers.--The board shall have the specific |
11 | power and duty: |

13 | (35) To levy fines against a licensed entity or licensed | <-- |
14 | facility or any affiliate, intermediary, subsidiary or |
15 | holding company of a licensed entity or licensed facility for |
16 | two or more violations in a one-year period of individuals |
17 | leaving a child under 14 years of age unattended in the |

1 | vehicle on property that is owned, leased or controlled by a |
2 | licensed facility or an affiliate, intermediary, subsidiary |
3 | or holding company of a licensed entity or licensed facility. |
4 | Section 2. Title 4 is amended by adding a section to read: |
5 | § 1509.2. Child endangerment protection. |
6 | (a) Warning.--Each slot machine licensee shall provide a |
7 | warning to all persons regarding the violations of leaving a |
8 | child unattended in a vehicle in its parking area. Each licensee |
9 | shall conspicuously post the following statement: |
10 | Any person who leaves a child unattended in a vehicle on this |
11 | property while visiting the casino is subject to criminal |
12 | penalties and will be banned from casinos in this |
13 | Commonwealth. |
14 | The statement shall be posted in clear view in the parking |
15 | areas, at each entrance and in other appropriate public areas of |
16 | the licensed facility as determined by the slot machine |
17 | licensee. |
18 | (b) Fine.--A slot machine licensee that fails to post the |
19 | signs in accordance with subsection (a) shall be assessed a fine |
20 | of $1,000 a day for each day the minimum number of signs is not |
21 | posted. |
22 | (c) Definition.--As used in this section, the term "parking |
23 | area" means all parcels of land and improvements owned by the |
24 | slot machine licensee or its affiliate, intermediary, subsidiary |
25 | or holding company that are contiguous with or adjoined directly |
26 | to the licensed facility where vehicles park. |
27 | (35) Notwithstanding any other provision of law, to levy | <-- |
28 | fines against a licensed gaming entity or any affiliate, |
29 | intermediary, subsidiary or holding company of a licensed |
30 | gaming entity for two or more violations in a one-year period |

2 | unattended in a vehicle on property, including a parking |
3 | area, that is owned, leased or controlled by a licensed |
4 | gaming entity or any affiliate, intermediary, subsidiary or |
5 | holding company of a licensed gaming entity. |
6 | Section 2. Title 4 is amended by adding a section to read: |
7 | § 1509.2. Child endangerment protection. |
8 | (a) Posting of signs.-- |
9 | (1) Each licensed gaming entity shall post signs |
10 | regarding the violation of leaving a child under 14 years of |
11 | age unattended in a vehicle on its property or in its parking |
12 | areas and the penalties for such violation. |
13 | (2) The signs shall be posted in clear view in the |
14 | parking areas, at each entrance and exit and in other |
15 | appropriate public areas of the licensed facility as |
16 | determined by the licensed gaming entity and as approved by |
17 | the board. |
18 | (3) The board shall determine the written content and |
19 | minimum number of signs to be posted at each licensed |
20 | facility. |
21 | (b) Fine.--A licensed gaming entity that fails to post the |
22 | signs in accordance with subsection (a) shall be assessed a fine |
23 | of $1,000 a day for each day the minimum number of signs is not |
24 | posted. |
25 | (c) Definition.--As used in this section, the term "parking |
26 | area" means all parcels of land, buildings and improvements |
27 | owned, leased or controlled by a licensed gaming entity or any |
28 | affiliate, intermediary, subsidiary or holding company of a |
29 | licensed gaming entity that are associated with or contiguous |
30 | with or adjoined directly to the licensed facility and in which |

2 | Section 3. This act shall take effect in 60 days. |
