| AN ACT |
| |
1 | Amending Title 66 (Public Utilities) of the Pennsylvania |
2 | Consolidated Statutes, in restructuring of electric utility |
3 | industry, providing for an economic and environmental impact |
4 | study. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Title 66 of the Pennsylvania Consolidated |
8 | Statutes is amended by adding a section to read: |
9 | § 2816. Economic and environmental impact study. |
10 | (a) Duty to conduct study.--The commission and the |
11 | Department of Environmental Protection shall conduct a joint |
12 | study of the anticipated economic, energy and environmental |
13 | impacts of the act of November 30, 2004 (P.L.1672, No.213), |
14 | known as the Alternative Energy Portfolio Standards Act. The |
15 | study shall: |
16 | (1) Estimate the consumer costs, job and electric rate |
17 | impacts and greenhouse gas emission reductions anticipated to |

1 | result from the programs authorized by the Alternative Energy |
2 | Portfolio Standards Act. |
3 | (2) Assess the impacts identified under paragraph (1) in |
4 | terms of a range of alternative future greenhouse gas control |
5 | options, including the Commonwealth's participation in the |
6 | ten-state Northeast Regional Greenhouse Gas Initiative, and a |
7 | range of alternative options based on reducing Statewide |
8 | greenhouse gas emissions from year 2000 levels by 10% to 30% |
9 | by the years 2020 to 2030. |
10 | (3) Include assessments of the impacts of the |
11 | alternative options on this Commonwealth's: |
12 | (i) Manufacturing economy. |
13 | (ii) Energy prices. |
14 | (iii) Energy production and consumption. |
15 | (iv) Real personal income. |
16 | (v) Gross State domestic product. |
17 | (4) Examine the potential for leakage of emission |
18 | reduction in this Commonwealth to other states, increasing |
19 | greenhouse gas emissions elsewhere and diluting the benefits |
20 | of reductions achieved through Pennsylvania's greenhouse gas |
21 | control initiatives, and the availability of options to |
22 | mitigate the leakage. |
23 | (b) Completion.--The study shall be completed and |
24 | transmitted to the General Assembly no later than 12 months |
25 | following the effective date of this section. |
26 | (c) Definition.--As used in this section "greenhouse gases" |
27 | are gas emissions, including carbon dioxide, methane, nitrous |
28 | oxide, hydrofluorocarbons, perfluorocarbons and sulphur |
29 | hexafluoride. |
30 | Section 2. This act shall take effect in 60 days. |
