| AN ACT |
| |
1 | Authorizing the Department of General Services, with the |
2 | approval of the Governor and the Department of Military and |
3 | Veterans Affairs, to grant and convey to Waynesburg |
4 | University certain lands situate in the Borough of |
5 | Waynesburg, Greene County. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Conveyance to Waynesburg University. |
9 | The Department of General Services, with the approval of the |
10 | Governor and the Department of Military and Veterans Affairs, is |
11 | hereby authorized on behalf of the Commonwealth of Pennsylvania |
12 | to grant and convey to Waynesburg University the following tract |
13 | of land together with any buildings, structures or improvements |
14 | thereon, situate in the Borough of Waynesburg, Greene County for |
15 | $170,000 and under terms and conditions to be established in an |
16 | agreement of sale. |
17 | Section 2. Description. |
18 | The property to be conveyed pursuant to Section 1 consists of |
19 | approximately 0.22-acres of land and an armory building, bounded |

1 | and more particularly described as follows: |
2 | ALL THAT CERTAIN tract of land situate in the Borough of |
3 | Waynesburg, Greene County more particularly bounded and |
4 | described as follows: |
5 | BEGINNING at the northwesterly corner of Washington Street |
6 | and Strawberry Alley; thence along the Westerly line of |
7 | Washington Street, North 1 degree 0 minutes East 80 feet to line |
8 | of land now or late of J.W. Ray, et al; thence Westwardly at |
9 | right angles to Washington Street, along said Ray line and line |
10 | of lands now or late of T.R. Huffman and M.R. Travis, 120 feet |
11 | to line of land now or late of T.R. Huffman; thence Southwardly |
12 | along said Huffman line, parallel with Washington Street, 80 |
13 | feet to the Northerly line of Strawberry Alley; thence |
14 | Eastwardly along the Northerly line of Strawberry Alley, 120 |
15 | feet to Washington Street, at the place of BEGINNING. |
16 | BEING Tax Parcel No. 2604-120. |
17 | BEING the same premises conveyed from J.B. Pollock and Alice |
18 | T. Pollock, his wife, C.H. Bowlby and Eva K. Bowlby, his wife |
19 | and T. Riley Huffman and Bertha H. Huffman to the Commonwealth |
20 | of Pennsylvania, by deed dated October 11, 1913 and recorded |
21 | October 14, 1913, in the Recorder of Deeds Office for Greene |
22 | County, Pennsylvania in Deed Book 231, Page 547. |
23 | Section 3. Conditions. |
24 | The conveyance shall be made under and subject to all lawful |
25 | and enforceable easements, servitudes and rights of others, |
26 | including but not confined to streets, roadways and rights of |
27 | any telephone, telegraph, water, electric, gas or pipeline |
28 | companies, as well as under and subject to any lawful and |
29 | enforceable estates or tenancies vested in third persons |
30 | appearing of record, for any portion of the land or improvements |

1 | erected thereon. |
2 | Section 4. Additional conditions. |
3 | Any conveyance authorized under this act shall be made under |
4 | and subject to the condition, which shall be contained in the |
5 | deed of conveyance, that no portion of the property conveyed |
6 | shall be used as a licensed facility, as defined in 4 Pa.C.S. § |
7 | 1103 (relating to definitions), or any other similar type of |
8 | facility authorized under State law. The condition shall be a |
9 | covenant running with the land and shall be binding upon the |
10 | Grantee, its successors and assigns. Should the Grantee, its |
11 | successors or assigns, permit any portion of the property |
12 | authorized to be conveyed in this act to be used in violation of |
13 | this subsection, the title shall immediately revert to and |
14 | revest in the Grantor. |
15 | Section 5. Special warranty deed. |
16 | The deed of conveyance shall be by Special Warranty Deed and |
17 | shall be executed by the Secretary of General Services in the |
18 | name of the Commonwealth of Pennsylvania. |
19 | Section 6. Costs and fees. |
20 | Costs and fees incidental to this conveyance shall be borne |
21 | by the Grantee. |
22 | Section 7. Proceeds. |
23 | The proceeds from the sale shall be deposited in the State |
24 | Treasury Armory Fund. |
25 | Section 8. Time limitation. |
26 | In the event that an agreement of sale between the parties is |
27 | not executed within one year of the effective date of this act, |
28 | the property may be disposed of in accordance with section 2405- |
29 | A of the act of April 9, 1929 (P.L.177, No.175), known as The |
30 | Administrative Code of 1929. |

1 | Section 9. Effective date. |
2 | This act shall take effect immediately. |
