AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, in limitation of time,

3

further providing for summary offenses involving vehicles.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 5553(a) and (d) of Title 42 of the

7

Pennsylvania Consolidated Statutes are amended to read:

8

§ 5553.  Summary offenses involving vehicles.

9

(a)  General rule.--Except as provided in subsection (b)

10

[or], (c) or (d), proceedings for summary offenses under Title

11

75 (relating to vehicles) must be commenced within 30 days after

12

the commission of the alleged offense or within 30 days after

13

the discovery of the commission of the offense or the identity

14

of the offender, whichever is later, and not thereafter.

(d)  Local ordinances on overtime parking.--Local ordinances

17

pertaining to overtime parking shall be subject to the

18

provisions of this section. A municipality may provide, by

ordinance, for follow-up notification of an overtime parking

2

violation. The notification shall be by first class mail to the

3

alleged offender and shall occur between 30 and 45 days

4

following the issuance of the parking ticket. When follow-up

5

notification is provided to an alleged offender, the limitation

6

period under subsection (a) shall be extended 30 days.

Section 2.  This act shall take effect in 60 days.
