| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, further providing for the |
3 | disbursement of the proceeds from forfeited property. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 6801 of Title 42 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a subsection to read: |
8 | § 6801. Controlled substances forfeiture. |

10 | (l) Municipal police agency share of proceeds.--Whenever a |
11 | municipal police agency was substantially involved in the |
12 | seizure of property ultimately forfeited by the court, the |
13 | proceeds shall be distributed so as to allocate at least 25% to |
14 | the municipal police agency. This percentage may be increased by |
15 | agreement. If more than one such agency is so involved, the |
16 | court shall equitably determine what portion of the 25% shall be |
17 | allocated to each agency. |
18 | Section 2. This act shall take effect in 60 days. |
