| AN ACT |
| |
1 | Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An |
2 | act relating to insurance; amending, revising, and |
3 | consolidating the law providing for the incorporation of |
4 | insurance companies, and the regulation, supervision, and |
5 | protection of home and foreign insurance companies, Lloyds |
6 | associations, reciprocal and inter-insurance exchanges, and |
7 | fire insurance rating bureaus, and the regulation and |
8 | supervision of insurance carried by such companies, |
9 | associations, and exchanges, including insurance carried by |
10 | the State Workmen's Insurance Fund; providing penalties; and |
11 | repealing existing laws," requiring health insurance policies |
12 | to provide coverage for vaccinations for human papilloma |
13 | virus. |
14 | The General Assembly of the Commonwealth of Pennsylvania |
15 | hereby enacts as follows: |
16 | Section 1. The act of May 17, 1921 (P.L.682, No.284), known |
17 | as The Insurance Company Law of 1921, is amended by adding a |
18 | section to read: |
19 | Section 635.4. Coverage for Human Papilloma Virus |
20 | Vaccinations.--(a) As used in this section "health insurance |
21 | policies" means all group or individual health or sickness or |
22 | accident insurance policies providing hospital or |

1 | medical/surgical coverage and all group or individual subscriber |
2 | contracts or certificates issued by any entity subject to one of |
3 | the following: |
4 | (1) this act; |
5 | (2) the act of December 29, 1972 (P.L.1701, No.364), known |
6 | as the "Health Maintenance Organization Act"; |
7 | (3) 40 Pa.C.S. Ch. 61 (relating to hospital plan |
8 | corporations); or |
9 | (4) 40 Pa.C.S. Ch. 63 (relating to professional health |
10 | services plan corporations). |
11 | (b) All health insurance policies offered, issued or renewed |
12 | after the effective date of this section shall provide coverage |
13 | for individuals at least eleven (11) years of age and less than |
14 | twenty-seven (27) years of age to receive the vaccination |
15 | against human papilloma virus. |
16 | (c) This section does not include the following: |
17 | (1) accident only; |
18 | (2) limited benefit; |
19 | (3) credit; |
20 | (4) dental; |
21 | (5) vision; |
22 | (6) specified disease; |
23 | (7) Medicare supplement; |
24 | (8) Civilian Health and Medical Program of the Uniformed |
25 | Services (CHAMPUS) supplement; |
26 | (9) long-term care or disability income; |
27 | (10) workers' compensation; |
28 | (11) automobile medical payment; or |
29 | (12) any combination of hospital indemnity, accident only, |
30 | fixed indemnity, credit, dental, vision, specified disease, |

1 | Medicare supplement, Civilian Health and Medical Program of the |
2 | Uniformed Services (CHAMPUS) supplement, long-term care or |
3 | disability income, workers' compensation or automobile medical |
4 | payment insurance, or other limited benefit plan. |
5 | Section 2. This act shall take effect in 60 days. |
