| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for information in |
3 | central repository or automated systems. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 9106(c)(1) and (d) of Title 18 of the |
7 | Pennsylvania Consolidated Statutes are amended to read: |
8 | § 9106. Information in central repository or automated systems. |

10 | (c) Dissemination of protected information.-- |
11 | (1) Intelligence information may be placed within an |
12 | automated or electronic criminal justice information system |
13 | and disseminated or secondarily disseminated only if the |
14 | following apply: |
15 | (i) The information is reliable as determined by an |
16 | authorized intelligence officer. |

1 | (ii) The department, agency or individual requesting |
2 | the information is a criminal justice agency which has |
3 | policies and procedures adopted by the Office of Attorney |
4 | General in consultation with the Pennsylvania State |
5 | Police which are consistent with this act and include: |
6 | (A) Designation of an intelligence officer or |
7 | officers by the head of the criminal justice agency |
8 | or his designee. |
9 | (B) Adoption of administrative, technical and |
10 | physical safeguards, including audit trails, to |
11 | insure against unauthorized access and against |
12 | intentional or unintentional damages. |
13 | (C) Labeling information to indicate levels of |
14 | sensitivity and levels of confidence in the |
15 | information. |
16 | (iii) The information is requested in connection |
17 | with the duties of the criminal justice agency requesting |
18 | the information, and the request for information is based |
19 | upon a name, fingerprints, modus operandi, genetic |
20 | typing, voice print or other identifying characteristic. |

22 | [(d) Secondary dissemination prohibited.--A criminal justice |
23 | agency which possesses information protected by this section, |
24 | but which is not the source of the information, shall not |
25 | disseminate or disclose the information to another criminal |
26 | justice agency but shall refer the requesting agency to the |
27 | agency which was the source of the information. This prohibition |
28 | shall not apply if the agency receiving the information is |
29 | investigating or prosecuting a criminal incident in conjunction |
30 | with the agency possessing the information. Agencies receiving |

1 | information protected by this section assume the same level of |
2 | responsibility for the security of such information as the |
3 | agency which was the source of the information.] |

5 | Section 2. This act shall take effect in 60 days. |
