AN ACT

Amending the act of September 30, 1983 (P.L.160, No.39),

2

entitled "An act establishing salaries and compensation of

3

certain public officials including justices and judges of

4

Statewide courts, judges of courts of common pleas, judges of

5

the Philadelphia Municipal Court, judges of the Philadelphia

6

Traffic Court, district justices and the Governor, the

7

Lieutenant Governor, the State Treasurer, the Auditor

8

General, the Attorney General and certain other State

9

officers and the salary and certain expenses of the members

10

of the General Assembly; and repealing certain inconsistent

11

acts," further providing for the compensation of members of

12

the General Assembly.

The General Assembly of the Commonwealth of Pennsylvania

14

hereby enacts as follows:

Section 1.  Section 4 of the act of September 30, 1983

16

(P.L.160, No.39), known as the Public Official Compensation Law,

17

reenacted and amended November 16, 2005 (P.L.385, No.72), is

18

amended by adding a subsection to read:

Section 4.  Members of the General Assembly.

(e)  Forfeiture of salary during periods of budget impasse

22

beyond July 1.--Notwithstanding any other provision of this act

23

or other law to the contrary, during any calendar year in which,

by July 1 of that calendar year, no general appropriation act

2

has been enacted for the fiscal year beginning July 1 during

3

that calendar year, the persons identified under subsections (a)

4

and (b) shall forfeit that portion of their salaries

5

attributable to the period from July 1 of that calendar year to

6

the date on which a general appropriation act for that fiscal

7

year is enacted.

Section 2.  This act shall apply to all persons identified

9

under section 4(a) and (b) of the act who are elected, appointed

10

or hired to their respective offices or jobs after the effective

11

date of this section.

Section 3.  This act shall take effect in 60 days.
