A CONCURRENT RESOLUTION

Directing the Joint State Government Commission to establish a

2

bipartisan legislative task force and an advisory committee

3

to conduct a study of capital punishment in Pennsylvania and

4

to report its findings and recommendations to the General

5

Assembly.

6

WHEREAS, From 1915 to 1962, 350 people were executed by

7

electrocution in Pennsylvania; and

8

WHEREAS, In 1990, the method of execution was changed to

9

lethal injection; and

10

WHEREAS, The first execution by lethal injection occurred in

11

1995; and

12

WHEREAS, Since 1995, three individuals have been executed;

13

and

14

WHEREAS, The total number of people executed in Pennsylvania

15

to date is 353; and

16

WHEREAS, As of June 1, 2011, 213 people are sentenced to

17

death in Pennsylvania; and

18

WHEREAS, Family members of a murder victim struggle to cope

19

with the loss of their loved one and need services from the

Commonwealth in order to manage that loss; and

2

WHEREAS, The financial costs of attempting to implement the

3

death penalty during a national economic crisis may place a

4

burden on the Commonwealth that is not proportionate to what the

5

citizens of Pennsylvania are receiving in return; and

6

WHEREAS, The American Bar Association has identified several

7

areas in which Pennsylvania's death penalty system falters in

8

guaranteeing each capital defendant fairness and accuracy in all

9

proceedings; and

10

WHEREAS, The Pennsylvania Supreme Court Committee on Racial

11

and Gender Bias in the Justice System has determined that racial

12

biases exist and that those biases significantly affect the way

13

parties, witnesses, litigants, lawyers, court employees and

14

potential jurors are treated; and

15

WHEREAS, The public is increasingly concerned about

16

individuals who are wrongly convicted of murder across the

17

nation and in this Commonwealth; and

18

WHEREAS, Postconviction DNA testing has shown that there are

19

wrongful convictions in Pennsylvania, even in capital cases;

20

therefore be it

21

RESOLVED, (the Senate concurring), That the General Assembly

22

direct the Joint State Government Commission to establish a

23

bipartisan legislative task force of four members of the Senate

24

and four members of the House of Representatives to conduct a

25

study of capital punishment in Pennsylvania; and be it further

26

RESOLVED, That the President pro tempore of the Senate and

27

the Speaker of the House of Representatives each appoint two

28

members of the task force and the Minority Leader of the Senate

29

and the Minority Leader of the House of Representatives each

30

appoint two members of the task force; and be it further

RESOLVED, That the Joint State Government Commission oversee

2

the creation of an advisory committee to assist the task force

3

in its study and recommendations; and be it further

4

RESOLVED, That the advisory committee consist of the

5

following members who shall be likely to make useful and

6

insightful contributions, including:

7

(1)  Two members of the religious, academic or ethical

8

communities, one appointed by the President pro tempore of

9

the Senate and one appointed by the Speaker of the House of

10

Representatives.

11

(2)  One member or former member of the judiciary,

12

appointed by the Chief Justice of the Pennsylvania Supreme

13

Court.

14

(3)  The Attorney General or his designee.

15

(4)  One prosecutor, appointed by the Pennsylvania

16

District Attorneys Association.

17

(5)  One criminal defense attorney who has handled death

18

penalty cases, appointed by the Pennsylvania Association of

19

Criminal Defense Lawyers.

20

(6)  One member of the Pennsylvania Bar Association,

21

appointed by the President of the Pennsylvania Bar

22

Association.

23

(7)  The Secretary of Corrections or his designee.

24

(8)  Two family members of murder victims, one appointed

25

by the Office of Victim Advocate and one appointed by Murder

26

Victims' Families for Reconciliation.

27

(9)  The President of the Pennsylvania Innocence Project

28

or his designee.

29

(10)  One criminologist, appointed by the President of

30

The Pennsylvania State University.

(11)  One member appointed by a civil rights

2

organization.

(12)  One member appointed by each member of the

4

legislative task force, for a total of eight legislative

5

appointees;

6

and be it further

7

RESOLVED, That the task force, with the assistance of the

8

advisory committee:

9

(1)  Review recent studies of the death penalty from

10

around the country.

11

(2)  Review recent studies pertaining to the death

12

penalty system or its subsystems in Pennsylvania.

13

(3)  Undertake a comprehensive analysis of the

14

Commonwealth's death penalty system to determine what policy

15

recommendations, if any, would guarantee that, in its

16

application and administration, capital punishment in this

17

Commonwealth is free from bias and error;

18

and be it further

19

RESOLVED, That the task force, with the assistance of the

20

advisory committee, review every stage of the capital process,

21

including pretrial procedures, jury selection, defense,

22

prosecution, trial procedures, postconviction appeals and

23

clemency procedures, and make findings and public policy

24

recommendations in each of the following areas, including, but

25

not limited to:

26

(1)  The risk of innocent people being sentenced to death

27

or executed. Where a wrongful conviction occurred in a

28

capital case or case that resulted in a long or life sentence

29

in this Commonwealth, the task force shall also look at the

30

factors and characteristics of these cases and determine

additional areas of study or policy change necessary.

(2)  Whether the selection of defendants for capital

3

trials is arbitrary, unfair or discriminatory in any way,

4

looking specifically at race, geography and socioeconomic

5

background and any other relevant characteristics of both the

6

defendants and victims.

7

(3)  Whether there is unfair, arbitrary or discriminatory

8

variability in the sentencing phase or at any stage of the

9

process. In determining the presence of unfair bias, the task

10

force shall review not only death penalty cases, but also

11

death-eligible cases where the death penalty was not sought.

12

(4)  Whether there is a significant difference in the

13

crimes selected for the death penalty as opposed to life in

14

prison.

15

(5)  The services that exist in this Commonwealth for

16

family members and loved ones of murder victims, whether

17

these services are sufficient, whether additional services

18

are provided in other states, whether additional services

19

should be provided in this Commonwealth and whether victims'

20

rights and services are provided on an equal basis to all

21

surviving family members regardless of their support for,

22

opposition to or neutrality on the death penalty.

23

(6)  The cost of the death penalty system, taking into

24

account all expenses from indictment to execution, as

25

compared to the cost of life in prison. In considering the

26

overall cost of the death penalty, the cost of capital trials

27

that result in life sentences, as well as the death sentences

28

that are reversed on appeal, shall be factored into the

29

equation.

(7)  Changes to the death penalty, if any, that would

ensure a system that is fairly administered and consistently

2

applied, free from impermissible racial, ethnic or geographic

3

bias and that would prevent the innocent from being sentenced

4

to death and execution.

5

(8)  Whether the law provides adequate protections for

6

specific vulnerable populations, such as persons with mental

7

retardation in accordance with the United States Supreme

8

Court ruling in Atkins v. Virginia, 536 U.S. 304, 122 S.Ct.

9

2242, and persons with mental illness.

10

(9)  Whether the death penalty rationally serves a

11

legitimate penological interest, such as deterrence;

12

and be it further

13

RESOLVED, That the task force propose new legislation, if

14

necessary and appropriate; and be it further

15

RESOLVED, That the task force be convened by the legislative

16

member with the most years of continuous service in the General

17

Assembly and, at its organizational meeting, shall elect from

18

among its legislative membership a chairperson, vice chairperson

19

and other officers the task force may deem necessary; and be it

20

further

21

RESOLVED, That the advisory committee choose a chairperson

22

from among its members; and be it further

23

RESOLVED, That members of the task force and advisory

24

committee serve without compensation, but may be reimbursed for

25

necessary expenses incurred in the performance of their duties,

26

within the limits of funds appropriated or otherwise made

27

available to the task force and advisory committee for their

28

purposes. All members of the task force or advisory committee

29

who are duly elected members of the General Assembly shall

30

remain members of the task force or advisory committee until

they report their findings and recommendations to the General

2

Assembly; and be it further

3

RESOLVED, That the task force and advisory committee hold

4

public hearings and may meet in closed executive session to make

5

their final deliberations; and be it further

6

RESOLVED, That all State, county and municipal agencies,

7

departments, boards, bureaus and commissions cooperate fully

8

with the task force and advisory committee; and be it further

9

RESOLVED, That the task force and advisory committee report

10

their findings and recommendations to the General Assembly no

11

later than two years after the date this resolution is adopted

12

in both houses.
