AN ACT

  

1

Establishing the Citizens Accountability Corps Act.

2

The General Assembly of the Commonwealth of Pennsylvania

3

hereby enacts as follows:

4

Section 1.  Short title.

5

This act shall be known and may be cited as the Citizens

6

Accountability Corps Act.

7

Section 2.  Findings.

8

The General Assembly finds and declares as follows:

9

(1)  The subprime mortgage crisis and resulting problems

10

in financial institutions and markets are having a widespread

11

negative impact on the United States and global economies.

12

(2)  The resulting recession is affecting all sectors of

13

the economy leaving many individuals unemployed.

14

(3)  The recession is causing subsequent financial

15

pressures on State government in increased demands for human

16

services and falling revenues.

(4)  The Federal Government will be providing historic

2

levels of funding for state governments as a result of the

3

American Recovery and Reinvestment Act.

4

(5)  The Commonwealth's government desires to insure that

5

the Federal funds are spent on appropriate projects and in an

6

efficient manner without increasing the size of Commonwealth

7

government.

8

(6)  Recently unemployed professionals are an available

9

talent pool that can assist the Commonwealth government in

10

meeting its objectives of efficient and appropriate use of

11

Federal funds.

Section 3.  Definitions.

13

The following words and phrases when used in this act shall

14

have the meanings given to them in this section unless the

15

context clearly indicates otherwise:

16

"Capital project."  A project which is financed, in whole or

17

in part, by Federal funds obtained pursuant to the American

18

Recovery and Reinvestment Act and which meets all of the

19

following:

20

(1)  Is an undertaking to construct, repair, renovate,

21

improve, equip, furnish or acquire any:

22

(i)  building, structure, facility or physical public

23

betterment or improvement;

24

(ii)  land or rights in land; or

25

(iii)  furnishings, machinery, apparatus or equipment

26

for a building, structure, facility or physical public

27

betterment or improvement.

(2)  Is designated in a capital budget as a capital

29

project.

30

(3)  Has an estimated useful life in excess of five

years.

(4)  Has an estimated financial cost in excess of

$100,000. This paragraph does not apply to original equipment

4

or furnishings for previously authorized public improvement

5

projects.

Capital projects are categorized as flood control projects,

7

highway projects, public improvement projects, redevelopment

8

assistance capital projects and transportation assistance

9

projects.

10

"Corps."  The Citizens Accountability Corps.

11

"Professionals."  Individuals who hold a valid license or

12

certification from the Commonwealth, or are registered with the

13

Commonwealth in an occupation relevant to the duties of the

14

Citizens Accountability Corps, including accounting,

15

architecture, public procurement, construction management,

16

engineering and law, who are unemployed and are eligible for

17

unemployment compensation benefits.

18

Section 4.  Establishment of Citizens Accountability Corps,

19

members and qualifications.

20

(a)  Establishment.--The Citizens Accountability Corps is

21

established as an independent agency.

22

(b)  Appointments.--The corps shall be governed by a board to

23

be known as the Citizens' Accountability Corps Board, consisting

24

of seven members to be appointed as follows:

25

(1)  Three persons to be appointed by the Governor, no

26

more than two of whom shall be registered in the same

27

political party as the Governor.

28

(2)  Four persons to be appointed by legislative leaders;

29

one each by the President pro tempore of the Senate, the

30

Minority Leader of the Senate, the Speaker of the House of

Representatives and the Minority Leader of the House of

All appointments shall be made within 30 days of the effective

4

date of this section.

(c)  Qualifications.--

6

(1)  Persons appointed under subsection (b) shall have an

7

educational background or professional experience in public

8

procurement, public accounting or auditing, engineering,

9

architecture, law or construction management.

10

(2)  Appointment authorities shall insure that at least

11

one person from each of the professions listed in paragraph

12

(1) are represented on the board.

13

(3)  All board members shall be residents of this

14

Commonwealth for a period of at least one year next preceding

15

his appointment.

16

(d)  Term.--Each person appointed shall serve for a term of

17

office which is conterminous with his appointing authority.

18

(e)  Quorum.--Four members shall constitute a quorum with

19

four votes necessary for official action.

20

(f)  Duties.--The board shall:

21

(1)  Hire an executive director and legal counsel who are

22

unemployed and who have filed for unemployment compensation

23

benefits within 30 days of appointment of final board member.

24

(2)  Hire five regional directors within 30 days of

25

hiring either the executive director or legal counsel,

26

whichever occurs last.

27

(3)  Submit quarterly reports to the Governor, the

28

Secretary of the Senate and the Chief Clerk of the House of

29

Representatives regarding the activity of the board.

30

(4)  Have its first meeting within ten days of the

appointment of the final member.

(g)  Expenses.--Board members shall not receive any

3

compensation except that they may be reimbursed for necessary

4

expenses incurred to carrying out their duties under this act.

5

(h)  Applicable statutes.--The following acts shall apply to

6

the board as follows:

7

(1)  The provisions of 65 Pa.C.S. Ch.7 (relating to open

8

meetings).

9

(2)  The board shall be considered an "independent

10

agency" for purposes of the act of February 14, 2008 (P.L.6,

11

No.3), known as the Right-to-Know Law, and the act of October

12

15, 1980 (P.L.950, No.164), known as the Commonwealth

13

Attorneys Act.

Section 5.  Executive director.

15

(a)  Duties.--The executive director shall oversee the daily

16

functions of the corps.

17

(b)  Compensation.--The executive director shall receive

18

compensation equal to 300% of what he would receive in

19

unemployment compensation benefits.

20

(c)  Removal.--The executive director may be removed for

21

cause by a vote of at least four members of the board.

22

Section 6.  Legal counsel.

23

(a)  Counsel.--The legal counsel shall provide legal advice

24

to the board, executive director and regional directors and

25

represent the board before courts and administrative agencies in

26

all matters.

27

(b)  Compensation.--The legal counsel shall receive

28

compensation equal to 300% of what he would receive in

29

unemployment compensation benefits if eligible.

30

(c)  Removal.--The executive director may be removed for

cause by a vote of at least four members of the board.

Section 7.  Regional directors.

(a)  Appointment.--The board shall appoint one regional

4

director to each region as follows:

5

(1)  Southeast - Philadelphia, Delaware, Montgomery,

6

Bucks, Chester, Berks, Lehigh, Northampton and Lebanon

7

counties.

8

(2)  Northeast - Monroe, Schuylkill, Pike, Wayne,

9

Susquehanna, Lackawanna, Luzerne, Carbon, Wyoming, Columbia,

10

Montour and Sullivan counties.

11

(3)  Central - Potter, Tioga, Clinton, Centre, Blair,

12

Huntingdon, Bedford, Fulton, Franklin, Adams, York,

13

Lancaster, Dauphin, Cumberland, Perry, Mifflin, Juniata,

14

Snyder, Union, Lycoming and Northumberland counties.

(4)  Southwest - Allegheny, Westmoreland, Cambria,

16

Somerset, Fayette, Indiana, Armstrong, Butler, Lawrence,

17

Beaver, Washington and Greene counties.

18

(5)  Northwest - Erie, Crawford, Warren, Forest, Venango,

19

Mercer, Jefferson, Lawrence, Clarion, Elk, McKean, Clearfield

20

and Cameron counties.

21

(b)  Duties.--Each regional director shall oversee and

22

coordinate the duties of the corps within his region and

23

contract with professionals within the region to accomplish the

24

purposes and duties of the corps under section 8.

25

(c)  Compensation.--Each regional director shall receive

26

compensation equal to 200% of what he would have received in

27

unemployment compensation benefits.

28

Section 8.  Corps duties.

29

The corps shall review contacts, inspect project sites and

30

audit expenditures related to capital projects funded in whole

or in part by funds received by the Commonwealth from the

2

Federal Government through the Federal economic stimulus

3

legislation.

Section 9.  Corps staff.

5

(a)  Professional compensation.--The corps shall contract

6

with professionals for purposes set forth in section 7.

7

Professionals shall not receive more than 150% of what he would

8

receive in unemployment compensation benefits.

9

(b)  Support staff.--The corps shall also contract with one

10

support staff person for the executive director, the legal

11

counsel and each regional director. Such staff person shall be

12

unemployed at the time of hiring. The board shall establish

13

annual compensation rates for support staff.

14

Section 10.  Expenditures.

15

The corps' expenses shall be paid from funds received by the

16

Commonwealth from Federal economic stimulus legislation. The

17

corps shall not receive more than one-half of 1% of the money

18

received by the Commonwealth.

19

Section 11.  Applicable statutes.

20

The following acts or parts of acts shall apply to the board

21

members and all employees, except support staff, and

22

professionals subject to this act as follows:

23

(1)  The provisions of 65 Pa.C.S. Ch. 11.

24

(2)  Notwithstanding the provisions of 65 Pa.C.S. §

25

1103(i), that subsection shall apply to board members

26

employees and contractors of the board except for support

27

staff under section 9(b).

(3)  The provisions of the act of July 19, 1957

29

(P.L.1017, No.451), known as the State Adverse Interest Act.

Section 12.  Expiration.

This act shall expire December 31, 2012.

Section 13.  Effective date.

3

This act shall take effect immediately.
