A RESOLUTION

Adopting a temporary rule of the Senate relating solely to

2

amendments to the General Appropriation Bill and other

3

appropriation bills for the fiscal year beginning July 1,

4

2012, including any amendments offered to or for supplemental

5

appropriations for prior fiscal years.

RESOLVED, That the Senate adopt a temporary rule to read:

7

TEMPORARY RULE

8

I. Budget Amendments on Senate Floor

9

1.  Floor amendments to the General Appropriation Bill or

10

other General Fund or special fund appropriation bills for the

11

fiscal year commencing July 1, 2012, or for any prior fiscal

12

year, shall be in order on second or third consideration only.

2.  Any amendment offered on the floor of the Senate to the

14

General Appropriation Bill or other General Fund or special fund

15

appropriation bills or other budget implementing legislation

16

(which collectively comprises and shall be referred to as the

17

2012-2013 Budget) that proposes spending from the General Fund

18

or any special fund for the Commonwealth 2012-2013 fiscal year,

19

or any prior fiscal year, at a level different from the amount

contained in the 2012-2013 Budget as reported from the

2

Appropriations Committee shall not be in order and may not be

3

considered unless the amendment includes a financial statement

appended thereto based on information from the latest report of

5

the Commonwealth's Independent Fiscal Office that sufficient

6

revenue in excess of the amount contained in the 2012-2013

7

Budget as reported from the Appropriations Committee is

8

projected to be available so that the amendment yields a

9

balanced budget or the amendment, or any "statement of intent"

10

appended thereto, contains sufficient revisions or reductions to

11

the 2012-2013 Budget so that the amendment yields a balanced

12

budget based on current and projected revenues. Where a proposed

13

alteration in the General Appropriation Bill is balanced, in

14

whole or in part, by a change in other appropriation bills or

15

other budget implementing legislation, the amendment shall have

16

appended thereto a "statement of intent" setting forth the

17

proposed adjustment to the other appropriation bill or bills

18

that will result in no net increase in the total spending from

19

the General Fund or any special fund contained within the

20

2012-2013 Budget as reported from the Appropriations Committee.

3.  For the purpose of this temporary rule, the Legislative

22

Reference Bureau, in drafting any amendment to the General

23

Appropriation Bill or any other appropriation bill, shall append

24

the "statement of intent" required for a proposal which involves

25

more than one bill.

26

4.  Any amendment offered on the floor of the Senate

27

proposing to make reductions in the following appropriations

28

shall be out of order unless the amendment provides for a

29

revision not contrary to the statutes governing such programs:

30

(a)  Medical assistance outpatient.

(b)  Medical assistance inpatient.

(c)  Medical assistance capitation.

(d)  Long-term care.

4

(e)  Supplemental Security Income - aged, blind, disabled.

(f)  School employees' retirement.

6

(g)  Transfer to Commonwealth Financing Agency.

II. Amendments in Appropriations Committee

8

1.  Any amendment offered in the Appropriations Committee to

9

the General Appropriation Bill proposing to make reductions in

10

the following appropriations shall be out of order unless the

11

amendment provides for a revision not contrary to the statutes

12

governing such programs:

13

(a)  Medical assistance outpatient.

14

(b)  Medical assistance inpatient.

15

(c)  Medical assistance capitation.

16

(d)  Long-term care.

17

(e)  Supplemental Security Income - aged, blind, disabled. 

18

(f)  School employees' retirement.

19

(g)  Transfer to Commonwealth Financing Agency.

III. Suspension

21

This temporary rule may be temporarily suspended only by a

22

vote of the majority of the members elected to the Senate.

IV. Expiration

24

This temporary rule shall expire upon the enactment of a

25

General Appropriation Act for the fiscal year beginning July 1,

26

2012.
