Amend HB 727 (house committee report) on page 1, between lines 16 and 17, by inserting the following and renumbering subsequent articles of added Chapter 46D, Code of Criminal Procedure, and cross-references to those articles accordingly:
Art. 46D.002. APPLICATION OF CHAPTER. This chapter applies to the prosecution of a capital offense other than a capital offense in which the defendant:
(1) caused with malice or forethought, or attempted to cause death to more than three people during the same criminal transaction.
