A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a prohibition on the sale of court records filed through |
|
|
the statewide electronic filing system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter I, Chapter 51, Government Code, is |
|
|
amended by adding Section 51.808 to read as follows: |
|
|
Sec. 51.808. PROHIBITION ON SALE OF COURT RECORDS. A person |
|
|
operating a system approved by the supreme court as required by |
|
|
Section 51.803 to electronically file a court record in a court in |
|
|
this state as part of the statewide electronic filing system may not |
|
|
sell or offer to sell a copy of any court record filed through the |
|
|
system unless the person selling or offering to sell the document is |
|
|
the clerk of the court in which the document was originally filed. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
