A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a dismissal or nonsuit of an application for a |
|
|
protective order. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 82, Family Code, is |
|
|
amended by adding Section 82.011 to read as follows: |
|
|
Sec. 82.011. DISMISSAL OR NONSUIT OF APPLICATION. An |
|
|
application for a protective order may not be dismissed and a |
|
|
nonsuit may not be taken unless the dismissal or nonsuit is approved |
|
|
by the court. The approval by the court of a dismissal or nonsuit of |
|
|
an application is without prejudice. |
|
|
SECTION 2. Section 82.011, Family Code, as added by this |
|
|
Act, applies to an application for a protective order that is |
|
|
pending in a trial court on the effective date of this Act or that is |
|
|
filed on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
