A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to assignment of traffic citations to justices of the |
|
peace in large counties. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 351, Local Government |
|
Code, is amended by adding Section 351.905 to read as follows: |
|
Sec. 351.905. ASSIGNMENT OF TRAFFIC CITATIONS TO JUSTICES |
|
OF THE PEACE IN LARGE COUNTIES. A sheriff and each constable in a |
|
county with a population of one million or more shall ensure that, |
|
in each county fiscal year, each justice of the peace in the county |
|
is assigned, to the extent possible, an equal number of citations |
|
for a violation of highway law under Title 7, Transportation Code, |
|
issued by county law enforcement in the county. |
|
SECTION 2. Section 351.905, Local Government Code, as added |
|
by this Act, applies only to a county fiscal year that begins on or |
|
after the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
