relating to the provision of Internet service to consumers. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subtitle B, Title 10, Business & Commerce Code, | ||
is amended by adding Chapter 326 to read as follows: | ||
CHAPTER 326. PROVISION OF INTERNET SERVICE TO CONSUMERS | ||
Sec. 326.001. DEFINITION. In this chapter, "consumer" | ||
means an individual who seeks Internet service for personal, | ||
family, or household purposes. | ||
Sec. 326.002. INTERNET SERVICE WITHOUT CANCELLATION FEE. | ||
An Internet service provider may not offer to a consumer a contract | ||
for Internet service that provides: | ||
(1) any fee or charge for cancellation of the contract | ||
by the consumer; or | ||
(2) any period during which the contract is not | ||
subject to cancellation by the consumer. | ||
Sec. 326.003. CONTRACT VOID. A contract entered into in | ||
violation of Section 326.002 is void and may not be enforced. | ||
SECTION 2. This Act applies only to a contract entered into | ||
or renewed on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2011. |
